This chapter shall be known and may be cited as the "Atlantic County Land Development Standards (ACLDS)."
The purpose of this chapter is to:
A. 
Provide procedures, rules, regulations and standards for review and approval of land development applications in Atlantic County pursuant to the County Planning Act, N.J.S.A. 40:27-1 et seq., and the Pinelands Protection Act, N.J.S.A. 13: 18A-1 et seq., and regulations promulgated thereunder.
B. 
Coordinate the review of land development applications with various state, regional, County and municipal regulatory bodies to ensure a comprehensive, coordinated and efficient review process.
C. 
Provide standards to ensure that land development throughout the County proceeds in accordance with the goals and policies of the County Master Plan and other adopted County plans.
D. 
Institute standards for assessing an applicant a fair share of the cost of improvements required by the land development.
Pursuant to N.J.S.A. 40:41A-1 et seq., the Optional County Charter Law, and N.J.S.A. 40: 27-1 et seq., the County Planning Act, made applicable by the Code of Atlantic County, New Jersey, § 4-59 and this chapter, the Atlantic County Office of Policy, Planning and Economic Development has authority to render decisions on all applications for land development. Nonetheless and pursuant to N.J.S.A. 40: 27-6.8, the Atlantic County Office of Policy, Planning and Economic Development vests this power, with regard to site plan and subdivision applications, with the Development Review Committee of the Atlantic County Planning Advisory Board.
A. 
The words "shall" and "must" are mandatory and not discretionary.
B. 
The words "should" and "may" are discretionary and not mandatory.
C. 
Words used in the singular shall include the plural and the plural shall include the singular; words used in the present tense shall include the future tense.
D. 
All references to "the County" herein shall refer to the County of Atlantic.
E. 
All references to "Regional Planning" herein shall refer to the Atlantic County Department of Regional Planning and Development.
All resolutions or ordinances, or parts of resolutions or ordinances, which are inconsistent with the provisions of this chapter are hereby repealed to the extent of such inconsistency.
If any provision of this chapter shall be held to be invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of this chapter as a whole or of any provisions hereof other than that which is specifically held to be invalid or unconstitutional.
