No animals or fowl other than domesticated pets, nor the commercial raising of all animals or fowl, shall be kept or allowed within the Village except in areas used for agricultural purposes or as follows:
A. 
Chickens.

(1) 
The keeping of chickens shall be allowed in zoned Residential-Scale Commercial, Village Residential and Rural Development districts by permit subject to the conditions below.
(2) 
Minimum one-acre lot size (43,560 square feet) in zoned Residential-Scale Commercial. Minimum 0.25 acre lot size in zoned Village Residential and Rural Development.
(3) 
Minimum setback for chicken coops or shelters of 100 feet from off-premises structures in zoned Residential-Scale Commercial. Minimum setback of 50 feet from off-premises structures in zoned Village Residential and Rural Development. Additionally, chicken coops or shelters shall be set back at least 10 feet from the owner’s property line in all three districts.
(4) 
Shelters: Maximum size of 12 feet wide by 12 feet long by 10 feet high at the peak from the ground in zoned Residential-Scale Commercial district. Maximum size of six feet wide by six feet long by 10 feet high at the peak from the ground in zoned Village Residential and Rural Development.
(5) 
Maximum of 25 chickens in zoned Residential-Scale Commercial. Maximum of five chickens in zoned Village Residential and Rural Development.
(6) 
No free range allowed (must be fenced) in all three districts.
(7) 
New construction must match the residential home's exterior and roofing in all three districts.
(8)

No roosters or waterfowl allowed in all three districts.
(10) 
The applicant shall be the property owner or tenant with written consent from property owner on license application in all three districts.
(11) 
Enclosures, shelters, coops and runs are only permitted in side or rear yards in all three districts.
(12) 
A permit application and initial fee is required. The permit shall remain in effect until December 31 of the year in which it is obtained. Applications to renew the permit shall be available at the Village Hall. It is the applicant’s responsibility to renew the permit by January 1. The annual permit fee shall be set by the Village Board.
Except as otherwise provided, any person who shall violate any provision of this article shall be subject to the penalties provided by Chapter 1, § 1-4, of this Code. Each violation and each day a violation continues or occurs shall constitute a separate offense. This section shall not preclude the Village from maintaining any appropriate action to prevent or remove a violation of this article.
