The Planning Commission shall consist of five members, all of whom shall be citizens of the City of Hazleton, Luzerne County, Pennsylvania. The term of office of the members shall be four years or until a successor is appointed. No more than three of the initial members shall be appointed to hold a term of four years. In the event of vacancies, the governing body shall appoint a member to fill the unexpired term. Members whose terms have expired shall hold office until their successors have been appointed.
All terms of members appointed herein and terms of all future members will end on the first Monday in January of the year set forth in the ordinance or resolution appointing them to the Commission.
The Planning Commission shall have the powers and duties set forth in the Municipalities Planning Code, 53 P.S. § 10209.1.
The Planning Commission may, with the consent of the governing body, accept and utilize any funds, personnel or other assistance made available by the county, the commonwealth or the federal government, or any of their agencies, or from private sources. The governing body may enter into agreements or contracts regarding the acceptance or utilization of the funds or assistance in accordance with the governmental procedures of the municipality.
From and after the passage of this article, the City Engineer of the City of Hazleton shall become a permanent adviser of the Hazleton City Planning Commission as the Commission Engineer and, as such, shall be notified by the Commission of any and all meetings.
Said City Engineer acting as Commission Engineer shall be authorized to sign his approval of all subdivision plans and subdivision street construction and utilities plans. He shall have no vote on any of the Commission actions and shall only act in an advisory capacity.
Said City Engineer acting as Commission Engineer is hereby authorized and directed to provide inspection of all subdivision street and utilities installations to verify that the same are built in accordance with approved plans. In providing this inspection service, the City Engineer is hereby authorized to make use of any City of Hazleton personnel that is required to accomplish such inspections.
Said City Engineer acting as Commission Engineer shall advise City Council in writing of any and all violations of any provisions of Chapter 475, Subdivision and Land Development, and any substitutions or omissions in the construction of any street or utility from the plans as approved by the Commission.
