This article is enacted for the purpose of providing reasonably
safe means of storing, measuring or dispensing gasoline or other combustible
fuel, including but not limited to those who store, measure or dispense
at retail or wholesale, and those who store or dispense for their
own private use.

This article is amended to include fuel oil tanks for heating
purposes over 1,000 gallons which shall be subject to this article,
and also tanks used for storing used oil which shall be subject to
this article.

All persons, companies or corporations storing, measuring or
dispensing gasoline or other combustible fuel, including but not limited
to those who store, measure or dispense at retail or wholesale, and
those who store of dispense for their own private use shall have the
tanks, pumps or other measuring apparatus inspected and tested in
the manner hereinafter provided at least once in a period of two years,
unless more frequent testing and inspection is required by the Bureau
of Code Enforcement.

The testing and inspection shall be made by the owner of such
tanks, pumps and appliances provided for the storing, measuring or
dispensing of gasoline or other combustible fuel, including, but not
limited to those who store, measure or dispense at retail or wholesale
and those who store or dispense for their own private use, by a mercury
gauge showing a pressure of five pounds maintained for a period of
30 minutes.

The testing and inspection shall be made by the owner of such
tanks, pumps or other measuring apparatus at their own expense and
in the presence of an authorized officer or agent of the Bureau of
Code Enforcement, with the Bureau having prior notice of five days
of the time and place when and where the test is to be made.

If such test and inspection shall be made by the direction of
the Bureau of Code Enforcement, then the owner of the tanks, pumps
or other measuring apparatus shall have 60 days' notice of the
time and place where the test is to be made. At the time the test
is to be made, the owner shall provide the necessary gauge and other
equipment required to make the required tests. If such gauge and equipment
is not provided by the owner, the Bureau may provide such means of
testing and the expense shall be chargeable to and collected from
the owner of such measuring apparatus.

When the tanks, pumps and equipment have been duly tested as
required by this article and approved by the Bureau of Code Enforcement,
a certificate shall be issued to the owner of such equipment authorizing
him to store, measure or dispense gasoline or other combustible fuel,
including but not limited to those who store, measure or dispense
at retail or wholesale and those who store or dispense for their own
private use, for a period of two years unless a reinspection and testing
within such period of two years shall be required by the Bureau.

Every person, company or corporation about to store, measure
or dispense gasoline or other combustible fuel, including but not
limited to those who store, measure or dispense at retail or wholesale,
and those who store or dispense for their own private use within the
City, shall, before beginning, have the tanks, pumps and equipment
tested and inspected as required by this article. Notice of the intention
of such parties to begin the storing, measuring or dispensing of gasoline
or other combustible fuel, including but not limited to those who
store, measure or dispense at retail or wholesale, and those who store
or dispense for their own private use, shall be given to the Bureau
of Code Enforcement in sufficient time to permit such testing and
inspection and receiving the required certificate from the Bureau
authorizing such parties to begin such activity.

Whenever the required test and inspection of the tanks, pumps
and equipment used in the storing, measuring or dispensing of gasoline
or other combustible fuel, including but not limited to those who
store, measure or dispense at retail or wholesale, and those who store
or dispense for their own private use in the City shows that the tanks
and equipment do not comply with the provisions of this article, then
such tanks, pumps and equipment shall not be used in any manner for
the storing, measuring or dispensing of gasoline or other combustible
fuel, including but not limited to those who store, measure or dispense
at retail or wholesale, and those who store or dispense for their
own private use until the proper additions and repairs have been made
so that the equipment can be used with safety to persons and property
in the City. No certificate shall be issued for the use of the tanks,
pumps and equipment until the proper and necessary repairs and additions
have been made.

No person or company shall operate any tank, pump and equipment
for the storing, measuring or dispensing of gasoline or other combustible
fuel, including but not limited to those who store, measure or dispense
at retail or wholesale, and those who store or dispense for their
own private use in the City otherwise than required by this article,
and the operation of such means of storing, measuring or dispensing
of gasoline or other combustible fuel, including but not limited to
those who store, measure or dispense at retail or wholesale, and those
who store or dispense for their own private use in violation of the
provisions hereof shall subject the operator and owner to a summary
offense and punishment as provided in Section 101.99 of the Administrative
Code.
