No person shall operate any loudspeaker, radio, phonograph or other instrument for the reproduction of sound outside of any building or in the public streets, highways and other places of the City, without first having obtained a license to do so as hereinafter provided. Any person who operates any such loudspeaker, radio, phonograph or other instrument for the reproduction of sound without first having obtained a license as herein provided shall be guilty of a violation of this article and subject to its penalty.

Any person who desires to operate any loudspeaker, radio, phonograph or other instrument for the reproduction of sound, in any street, highway or public place in the City, or any part of which or attachment thereto is outside of a building so that the sound therefrom will spread into any street, highway or other public place, shall make application to the Police Bureau for a license. If the Police Chief is satisfied that the granting of such license will not create a public nuisance or interfere with the public peace or with the rights of any other person, the Police Chief may grant a license to the applicant for a period of not more than 10 days, provided the applicant shall first pay the City Treasurer a license fee of $10 per day for such license.

(a) 
Whenever a license is granted as provided in Section 325.02, it shall entitle the holder thereof to operate a loudspeaker or other such instrument, according to such restrictions as the Police Chief shall impose at the time of the issuance of the license, and subject to the following general restrictions:
(1) 
No such loudspeaker or other instrument may be operated before 8:00 a.m. or after 8:00 p.m. on any day.
(2) 
No such loudspeaker or other instrument may be operated in any residence zone in the City at any time, or within the vicinity of any school building, hospital or church.
(b) 
Any person holding a license under this article who violates any of the restrictions imposed by the Police Chief or by this article shall be guilty of the violation of this article and subject to its penalty.
Any person who violates any provision of this article shall be punished as provided in Section 101.99 of the Administrative Code.
