A. 
No excavating, grading, filling, or paving of land, or the construction, alteration or addition to a structure or building shall be permitted on moderate, steep, very steep or extremely steep slopelands until the Building Inspector and Village Engineer have reviewed the plans for the proposed construction and determined that the following have been addressed and mitigated to their satisfaction:
(1) 
The extent of disturbance to the slopeland is the minimum necessary;
(2) 
Adequate stormwater erosion control measures during and after construction have been installed and thereafter maintained; and
(3) 
Adequate safeguards to protect the neighboring properties during construction are installed and maintained.
B. 
Very steep and extremely steep slopes.

(1) 
Construction in very steep slopes and extremely steep slopes will be limited to only those improvements that the applicant demonstrates to the Planning Board to be necessary and required and can only be located in those areas on the property.
C. 
The slopelands review by the Building Inspector, Village Engineer and Planning Board shall be in addition to any other approval required by the Code.
For construction on regulated slopelands the following shall be filed with the Village:
A. 
A current, up-to-date topographical survey of the property, showing existing contours with vertical intervals of no greater than two feet; the location and boundaries of any slopelands clearly labeled as moderate slope, steep slope, very steep slope, or extremely steep slope; the location of all existing buildings, structures, driveways and utilities serving the property; existing easements and rights-of-way; the present use of land and structures; the specific type, size and location of trees with a circumference of 18 or more inches measured at a height four feet above ground level; and any other existing features or characteristics of the land which are required by the Building Inspector and Village Engineer.
B. 
A plan showing all proposed construction and the disturbance of any portion of the site, including building and driveway locations, parking areas, landscaping, grading, drainage, utilities and other planned site uses or improvements contemplated by the applicant.
C. 
Specific design and construction procedures to be followed which will mitigate the potential impact of the proposed site development on the slopelands both during and after construction. This shall include, but not be limited to, location and type of construction and material to be used, erosion control measures, site restoration, plantings, and all other appropriate safeguards and precautions the Building Inspector and Village Engineer deem necessary.
D. 
The application fee and deposit, in an amount to be determined by resolution of the Board of Trustees, shall be deposited with the Village Clerk. For application for work that had been started or completed without the required approval, the application fee shall be tripled. The applicant shall be responsible for the reimbursement of Village expenses incurred, including but not limited to engineering, legal and hearing charges, as established by resolution of the Board of Trustees.
In reviewing construction on regulated slopelands, the following guidelines and standards shall be considered and applied:
A. 
Whether the proposed construction and the location for the requested activity on the lot are appropriate, taking into consideration the slopelands, lot shape, required setbacks, topography and other lot features, and impact on the surrounding properties.
B. 
The activity or construction proposed is the minimum necessary for the applicant's reasonable use and enjoyment of the land and is in keeping with the character of the surrounding properties and the Village.
C. 
Construction standards and precautions for approved construction are to be strictly adhered to. The installation and maintenance of erosion control measures, retaining walls to limit site disturbance and tree and vegetation protection, and other mitigation measures are priority actions that must be promptly implemented and thereafter maintained.
D. 
The applicant is required to be in compliance with all other applicable requirements of the Village, town, county, state and federal agencies, including stormwater management. The Village may withhold approval until all other approvals are obtained.
A. 
Before the Building Inspector and Village Engineer approve the proposed slopelands construction, notice of the proposed construction and opportunity to comment shall be provided to the adjoining property owners and all other property owners within 100 feet of the subject property. Notified property owners will have 10 business days from the date of mailing to submit comments to the Village concerning the proposed construction on regulated slopelands.
B. 
The Building Inspector and Village Engineer, in their sole discretion, may refer the application to the Planning Board for its consideration and approval. The Planning Board shall hold a public hearing on the application on five days' mailing notice to the adjoining property owners and all other property owners within 100 feet. The Planning Board shall only approve those applications where it determines that the proposed activity on the slopelands is in compliance with the provisions and intent of this chapter and will not have a significant adverse impact on the slopelands, the site and the surrounding properties. The Planning Board may impose such conditions to the slopeland permit as it deems necessary and proper, including the posting of security to assure compliance with the slopeland permit and this chapter.
