[HISTORY: Adopted by the Town Board of the Town of Shelter Island 5-28-2021 by L.L. No. 6-2021. Amendments noted where applicable.]
A. 
It is the intent of this article to protect the health and safety of the public at heavily used public locations, particularly those frequented by families with children, from the effects of secondhand smoke and to ensure their quiet enjoment of such Town properties.
B. 
This chapter is adopted as a local law pursuant to the authority conferred in Article IX of the New York State Constitution; Article 2, § 10, of the New York Municipal Home Rule Law; and Article 4 of the New York Town Law.
A. 
This chapter shall not be construed to subject the Town of Shelter Island, and Fire District or Fire Department therein or any officers or employees thereof to any civil or other liability for any damage to persons or property.
B. 
If any provision of this chapter or its application to any person or circumstances is held invalid, such portion shall be deemed a separate, distinct and independent provision, and such finding shall not affect the validity of the remaining portions of this chapter.

Smoking, to include burning or vaping of any material, including but not limited to tobacco, hemp and marijuana, shall be prohibited at all times:
A. 
At any property owned or operated by the Town of Shelter Island, including any beach or park as defined by § 36-9 of the Town of Shelter Island Town Code.
Violation of any provision of Article I of this chapter shall be a violation under the Penal Law and subject to a fine of not more than $250 or imprisonment of not more than 15 days. Each incidence of noncompliance shall be considered a separate violation.
