It shall be unlawful for any person, persons, corporation or association of persons to enter upon any street, alley, road or highway of the Township for the purpose of laying any main or branch pipe line or conduit for whatsoever purpose the same may be used, without the consent or permission of the Board of Township Commissioners, being first duly obtained by ordinance and under such terms, conditions, stipulations and regulations as may be agreed upon, provided that no part of this article, except § 368-2, shall apply to any person, persons, corporation or association of persons making house or service connections with such main or branch lines.

Each and all of such persons, corporations or associations, without exceptions, in laying, relaying or repairing the said lines or conduits, shall comply with the requirements of Article III, Openings and Excavations, of this chapter.[1]

At the time of the laying, relaying or repairing of any such pipe line or conduit, the same shall be done under the supervision and inspection of the Supervisor of the district appointed by the Board of Township Commissioners as provided in the ordinance recited in § 368-2, and, that the health, convenience and safety of passers and travelers along the said public highways may be subserved, the surface of the said highways, underlaid with said lines or conduits, shall be regularly thereafter inspected by said Supervisor, and such persons, corporations or associations shall be duly notified of any failure to comply with any of the regulations provided in this article and of any defect so observable in the maintenance of the said lines or conduits dangerous to the health or safety of the persons aforesaid, which defects thereupon shall forthwith be caused to be repaired by the said persons, corporations and associations.

To provide for the costs and expenses of the supervision and inspection, at the time of the laying of the said pipe lines and conduits, each and every person, persons, corporation or association of persons, aforesaid, without exceptions, shall pay the Township the sum as set by resolution of the Board of Supervisors for each Supervisor for each and every day employed in the supervision and inspection aforesaid, provided that the charge for supervision of work in any one district of said Township shall not exceed such amount.

This article shall be enforced by a criminal action in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Any person, partnership, corporation or other entity who or which violates or permits a violation of the provisions of this article shall, upon conviction in a summary proceeding, pay a fine of not more than $1,000, plus the costs of prosecution, and in default of the payment of the fine and costs of prosecution, shall be imprisoned for a period not exceeding 90 days. Each day, or part thereof, that a violation continues shall constitute a separate violation.
