Editor's Note: This ordinance also repealed former Ch. 147,
Garbage, Rubbish and Refuse, which consisted of Article I, Disposal,
adopted as Ch. 58, Art. I, of the 1973 Code, as amended; and Art.
II, adopted as Ch. 58, Art. II, of the 1973 Code, as amended.
All garbage, trash, and solid waste collected within the municipality
shall be disposed of at an approved disposal facility in accordance
with the applicable standards and regulations, as may be currently
in effect, of the appropriate governmental entities having jurisdiction
for such matters, including but not limited to the Camden County Solid
Waste Management Plan and the Division of Solid and Hazardous Waste
of the New Jersey Department of Environmental Protection.
A.
The Borough of Somerdale, through its authorized contractors, designated
agents and/or employees, will collect and remove weekly only the garbage,
trash and solid waste described herein, when such matter is placed
in Borough-issued carts and is placed for collection in the manner
prescribed. No return call will be made for any garbage, trash or
solid waste not placed at the curb at the times prescribed.
B.
Collection shall be for only single-family homes, townhouses, twin
homes, duplexes, apartment units, condominium units, all municipal
buildings and facilities including the fire company, all churches,
the community center, certain designated businesses, and one elementary
school, but collection shall not include the large industries in the
industrial park, any shopping center with more than five stores, the
high school, or any large business.
For the purposes of this chapter, the terms used herein are
defined as follows:
Residue from the combustion of any type of solid fuel such
as wood, coal, coke, charcoal or like substances.
Bulk items consist of household items that do not fit in
your blue cart, such as furniture, mattresses, carpet, and other items
too big to fit in the blue cart. Bulk trash cannot contain hazardous
materials, electronics, vegetative/yard waste, construction and/or
remodeling debris.
Miscellaneous material such as rags, leather goods, rubber,
broken glass, crockery and similar materials. "Rubbish" shall not
include logs, earth, sand, bricks, mortar or other substances which
may accumulate from building operations.
All garbage and trash as included within the definition of
"sold waste" types 10 and 13 pursuant to the Division of Solid and
Hazardous Waste regulations, N.J.A.C. 7:26 et seq., as currently defined
or as may be amended from time to time.
A.
Residential solid waste carts. The only acceptable carts for trash
disposal shall be the Borough issued plastic sixty-four-gallon or
ninety-five/ninety-six-gallon blue carts. Carts shall be watertight
with a tight-fitting lid. Carts must be maintained in a manner that
is not a danger to the health and safety of the community. The owner
or tenant shall be responsible for the removal of any solid waste
spilled by animals or vandals as a result of defective or inadequate
carts or covering of carts. In order to assure the best possible compliance
with the regulations of this chapter, whenever there is more than
one unit disposing of solid waste or trash from any one lot, each
cart shall be clearly and properly marked to identify the address
or unit number for which said container is being utilized.
B.
Commercial solid waste containers. The commercial containers for
the institutional or municipal collection sources shall be sturdy
and free of damage which could cause harm or injury to a collector's
equipment or personnel.
All garbage, trash and solid waste shall be prepared for collection
as follows:
A.
Carts should be placed at the curb with the wheels in towards the
sidewalk and metal support bar and cart opening facing the roadway.
Carts must be placed a minimum of three feet from any obstruction,
mailbox, utility pole, vehicles and a minimum of three feet between
each individual trash carts. Carts shall not be overfilled to not
allow the lid to be closed completely to prevent any solid waste from
being scattered about by wind or other elements. No material will
be collected that is outside of the cart(s) on the ground. No material
is to be placed on the top of the cart(s). All garbage, trash, and
solid waste must be completely inside the cart(s). Damaged or leaking
carts shall be replaced at the expense of the owner. No sixty-four-gallon
carts shall weigh more than 200 pounds, no ninety-five/ninety-six-gallon
carts shall weigh more the 300 pounds.
B.
Mattresses and/or box springs must be fully wrapped, separately,
in plastic and securely taped or they will not be collected.
C.
Bulk trash must be placed at the curb in a manner that is easily
accessible to the collection vehicle. Bulk items must be scheduled
for collection through the provided phone number, scheduling must
be made at least 24 hours in advance of the scheduled collection day
on the east or west side of town. No additional items will be added
to the list on the collection day. A list of the bulk items to be
collected must be provided. Waste resulting in the renovation of a
dwelling is the responsibility of the individual or contractor performing
the work to have it removed and disposed of in compliance with all
state and local solid waste and source separation regulations. All
bulk items set out for collection must be free from hazards, no nails,
screws, sharp glass or plexiglass edges, or any other objects that
could be harmful to the persons collecting the bulk items, these hazards
must be removed.
D.
Paints, motor oil, hazardous waste, electronic waste (e-waste), single
stream recycling, light metal, iron should all be discarded in a safe
manner and never placed in the curbside weekly or bulk collections.
Residents must follow the guidelines that are provided in the borough
service guide book, or the county hazardous waste website for proper
disposal.
E.
Hedge trimmings, light brush clippings, grass clippings, garden wastes,
any compostable vegetative waste, all such tree trimming waste that
is less than four feet in length shall be placed in open containers
or paper biodegradable paper bags not to exceed 40 pounds for collection
with the vegetative/yard waste collection on your specified collection
day and not to be placed in with the solid waste.
A.
Each and every owner, tenant, or other person occupying any dwelling
or structure or portion thereof in the Borough of Somerdale shall
be required to:
(1)
Procure proper carts for the storage of all solid waste.
(2)
Collect, store and place all accumulations of such solid waste in
proper carts.
(3)
Place all carts at the curb on the public street in front of each
lot, building, apartment or dwelling house where the same shall be
accessible for collection from 6:30 a.m. of the day specified for
collection.
(4)
No owner or tenant shall place any carts at the curb on the public
street for collection and disposal prior to 4:00 p.m. of the day preceding
the day specified for collection.
B.
It shall be unlawful to place or store any solid waste in any paper
bags, wooden barrels, baskets, drums or any other type of container
other than the type of cart specified in this chapter. Any carts/containers
other than those specified in this chapter may be classified as solid
waste and carted away.
C.
It shall be unlawful to place for the solid waste collection any recyclable material that should instead be placed for the recyclable material collection. All materials that are deemed recyclable pursuant to Chapter 201 of the Borough Code shall be placed for the recyclable collection and not for the solid waste collection. All persons who participate in the solid waste collection shall be required to also participate fully in the recyclable material collection.
It shall be unlawful for any unauthorized person or corporation
to collect, pick up, or in any other way disturb the solid waste deposited
in any container placed for collection on any curb, street or public
place.
A.
Burning of refuse, rubbish and other materials is prohibited. It
shall be unlawful to set fire to or burn any refuse, rubbish or other
material mentioned in this article on any land in this Borough.
B.
No person shall discard or dump any refuse, rubbish, household or
commercial solid waste in any place or on any land in the Borough
not specifically designated for the purpose of solid waste disposal.
C.
It is unlawful to bring any solid waste, garbage, rubbish, and/or
refuse from an outside location into the Borough of Somerdale for
disposal.
D.
No person having custody or control or residential, industrial or
business premises from which solid waste, including recyclables, is
collected for disposal by the Borough shall permit or cause any solid
waste, including recyclables, within his control, to become a hazard
to public travel, health or safety.
The provisions of this chapter shall be enforced by the Borough
of Somerdale Code Enforcement Officer and/or the Department of Public
Works, which shall designate inspectors empowered to issue complaints
for violations of this chapter in accordance with the rules governing
the courts of the State of New Jersey.
