The Authority shall have the discretion to waive any requirements under this ordinance where the Tribe has a substantial membership interest in the tenant or lessee entity under a lease or derives a substantial economic benefit from a sublease given pursuant to a lease that is otherwise in conformity with this ordinance; but where a conflict between this ordinance and such a business site lease exists, the ordinance shall control. Accordingly, any waiver of ordinance provisions, except as specifically provided in §§ 912(c), 913(b)(3), 915(d), 916(b), 917(i) and 920, must be done by duly enacted Tribal resolution and incorporated into the lease as an attachment.

If any provision in this ordinance shall be declared to be invalid or unenforceable by a tribunal of competent jurisdiction, such declaration shall not affect the validity or effectiveness of the remainder of the provisions in this ordinance, which shall continue to be valid and enforceable.
