For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section:
BOD (denoting BIOCHEMICAL OXYGEN DEMAND)
The quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20° C., expressed in parts per million by weight.
BUILDING SEWER
The extension from the building drain to the public sewer.
BUILDING SEWER DRAIN
That part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste and other drainage pipes inside the walls of the building and conveys it to the building sewer beginning at the inner face of the building wall to the property line.
COMBINED SEWER
A sewer receiving both surface runoff and sewage.
GARBAGE
Solid wastes from the preparation, cooking and dispensing of food and from the handling, storage and sale of produce.
INDUSTRIAL WASTES
The liquid wastes from industrial processes as distinct from sanitary sewage.
NATURAL OUTLET
Any outlet into a watercourse, pond, ditch, lake or other body or surface water or groundwater.
It shall be unlawful to discharge to any natural outlet within the Town or in any area under the jurisdiction of the Town any sanitary sewage, industrial wastes or other polluted waters except where suitable treatment has been provided in accordance with the provisions of this chapter.
The owner of any house, building or other property used for human occupancy, employment, recreation or other purpose, connected to the Town sewer system or situated within the Town and abutting on any street, alley or right-of-way in which there is located a public sanitary sewer of the Town, is required, at his/her expense, to install suitable toilet facilities therein and to connect such facilities directly with the proper public sewer in accordance with the provisions of this chapter within 90 days after the date of official notice to do so, provided that such public sewer is within Town limits, and within 500 feet of the property line.
Properties outside of Town are required to meet all in Town regulations concerning water and sewer plumbing and connections. All new customers outside of Town must connect both water and sewer services at the current rates as set by Council from time to time.
Except as otherwise provided in this chapter, it shall be unlawful to construct or maintain any privy, privy vault, septic tank, cesspool or other facility intended or used for the disposal of sewage within the Town.

Privies, cesspools and septic tanks not prohibited by this chapter shall be maintained by the owners thereof in a sanitary condition satisfactory to the State Department of the Environment and shall be emptied and cleaned by such means and in such manner as prescribed by that Department.
No person shall maliciously, negligently or without authority break, damage, destroy, uncover, deface, cause to be inaccessible, or tamper with any structure, appurtenance or equipment which is part of the sewage works. Any person violating this section shall be guilty of a misdemeanor punishable by a fine not to exceed $1,000 and/or imprisonment not to exceed six months.

Any person found to be violating any provision of this article except § 280-37 shall be served by the Town with written notice stating the nature of the violation and requiring satisfactory correction within five business days thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations.
A. 
Any person who shall continue any violation beyond the time limit provided for in a written notice, or who violates these provisions shall, upon conviction thereof, be guilty of a misdemeanor and shall be punished as provided in the Town Charter.
B. 
Any person guilty of violating any provision of this article except § 280-37 shall be guilty of a municipal infraction and shall be subject to a fine not to exceed $1,000. The offender shall pay the fine to the Town of Chesapeake City within 20 calendar days of receipt of a citation. Repeat offenders may be assessed a fine not to exceed an additional $100 from any previous violation/fine for each repeat offense. Each day a violation continues shall constitute a separate or repeat violation.
Any person violating any provision of this chapter shall become liable to the Town for any expense, loss or damage occasioned the Town by reason of such violation.
