As used in this article, the following terms shall have the meanings indicated:
PARKS
The grounds, buildings thereon, waters therein and any other property necessary for the operation thereof and constituting a part thereof which are now or hereafter will be maintained, operated and controlled by the City of Beacon for public park purposes.
SMOKING
The burning of a lighted cigar, cigarette, pipe or any other matter or substance which contains tobacco, cannabis, cannabinoid hemp or other product, including the use of an electronic smoking device that creates an aerosol or vapor.
A. 
No person in a park shall smoke or carry a lighted cigar, cigarette, pipe, or any other matter or substance which contains tobacco, cannabis, cannabinoid hemp or other product, and/or the use of an electronic smoking device that creates an aerosol or vapor shall not be permitted.
B. 
No person shall dispose of any smoking materials, including, but not limited to, cigarette or cigar butts and filters, in any place other than a receptacle designated for the deposit of such items.
The City of Beacon Police Department shall be charged with enforcement of this article and shall have the power and authority to issue summonses and tickets for violations thereof.
