Any person who shall operate a vehicle upon any street or portion thereof hereby or previously established as a one-way street other than in the direction established hereby or prior ordinance for vehicular traffic shall, upon conviction thereof, be sentenced to pay a fine of not less than $25 or more than $50, together with costs of prosecution.

§ 375-8 Vehicles in New Cumberland Borough Park.

[Added 6-5-1974 by Ord. No. 406]

All vehicles shall be required to travel in one direction only on the drive through the New Cumberland Borough Park in a direction shown by the one-way traffic signs erected along said drive.

Any person or persons violating any of the foregoing rules and regulations shall, upon conviction thereof before any Magisterial District Judge having jurisdiction be sentenced to pay a fine of not more than $50 and costs of prosecution, and in default of the payment thereof be imprisoned in the Cumberland County Jail for a period of not more than 30 days.

§ 375-9 Speed limits established on certain streets.

§ 375-10 Traffic signals at certain intersections.

At the following intersections, official traffic signals shall be erected (or if already erected are hereby ratified), and traffic at such intersections may be directed by such signals:

§ 375-11 Certain traffic to keep to right.

All vehicles traveling north and south shall keep to the right of Market Square, with north-bound traffic on the east and southbound traffic on the west of Market Square.

All vehicles shall keep to the right of the semicircular plot on Westover Drive at Warren Street.

Any person who shall operate a vehicle in violation of any of the provisions of this section shall, upon conviction thereof, be sentenced to pay a fine of $10 and costs of prosecution, and, in default of payment thereof, imprisonment for not more than five days.

§ 375-12 U-turns prohibited on certain streets.

No operator of any vehicle moving east on Third Street shall make a U-turn around Market Square. Any person who shall violate any of the provisions of this section shall upon conviction thereof, be sentenced to pay a fine of $10 and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment in the County Jail for not more than five days.

§ 375-13 Stop intersections established.

Note: By resolution unnumbered, but adopted July 11, 1962, Bridge Street (L.R. 250) was made a through highway from the Yellow Breeches Creek to the Lemoyne Borough Line and all traffic was directed to come to a full stop before entering or crossing Bridge Street after erection of proper signs.

§ 375-14 Use of certain streets restricted to certain classes of vehicles.

The following streets and alleys in the Borough shall be for the use of passenger vehicles only, and it shall be unlawful for any person to operate any other type of motor vehicle thereon, except that commercial vehicles may be operated thereon for the purpose of making local deliveries within such designated areas only:

Any person who shall operate a motor vehicle in violation of any of the provisions of this section shall, upon conviction thereof, be sentenced to pay a fine of not more than $25 and costs of prosecution and, in default of payment of such fine and costs, to imprisonment in the County Jail for not more than 10 days.

§ 375-15 Play highways authorized.

The Chief of Police, under direction of the Mayor, is hereby authorized to designate as "play highways," whenever he shall deem such action advisable, and for whatever period of time directed by him, any portion of any street or alley in the Borough, whereon sledding and coasting shall be permitted. Such highways shall be set apart and marked off for the purpose. No person shall operate any motor vehicle upon any play highway at any time when such highway shall be so designated, except in case of emergency, with special permission of the Mayor or of the police officer in charge, who shall first clear such highway of all persons using such highway for the purpose for which it was set apart. Any person who shall violate any of the provisions of this section shall, upon conviction thereof, be sentenced to pay a fine of not more than $10 and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment in the County Jail for not more than five days.

§ 375-16 Establishment of pedestrian warning zone and authorization for traffic control devices.

Penalty for violation. Any person who shall violate any of the provisions of this section shall be prosecuted and fined in accordance with the applicable provisions of the motor vehicle code, together with the costs of prosecution, to be collected as other fines and costs are now recovered by law.

§ 375-17 Severability.

The provisions of this chapter shall be severable, and if any of its provisions shall be held to be unconstitutional or illegal, such decision shall not affect the validity of any of the remaining provisions of this chapter. It is hereby declared as a legislative intent that this chapter would have been adopted had such unconstitutional or illegal provision not been included herein.

§ 375-18 Provisions to be continuation of existing regulations.

The provisions of this chapter, so far as they are the same as those of ordinances and regulations in force immediately prior to the enactment of this chapter, are intended as a continuation of such ordinances and regulations and not as new enactments. The provisions of this chapter shall not affect any act done or liability incurred, nor shall they affect any suit or prosecution pending or to be instituted to enforce any right or penalty or to punish any offense under the authority of any of these repealed ordinances and regulations.

§ 375-19 General handicap/disabled parking regulations.

No person shall park any vehicle in a parking space designated as a handicapped parking space, other than a person authorized to and displaying a handicap or disabled windshield placard within the vehicle, or a person authorized to and displaying a handicapped or disabled veteran license plate on the motor vehicle.

Two handicap parking spaces are hereby established at Market Square.

Penalty for violation:

(1)

Any person who shall violate any of the provisions of this section shall, upon conviction thereof, be sentenced to pay a fine of not less than $50, nor more than $200, together with the costs of prosecution, to be collected as other fines and costs are now recovered by law.

(2)

In addition to the penalty set forth above, a special penalty of not more than $50 may be imposed against any person violating Subsection A in accordance with 75 Pa.C.S.A. § 3354(g).

§ 375-20 Establishment of school zone area: placement of traffic control device; hours of operation.

School zone area and placement of traffic control devices. School Zone Area traffic control devices (signs) shall be posted at the following locations to notify motor vehicle traffic approaching a school zone area:

Hours of operation. This chapter shall be enforceable Monday through Friday, from 7:15 a.m. – 8:45 a.m., 11:30 a.m. – 12:50 p.m. and 2:45 p.m. – 3:45 p.m. during the school year. All traffic control devices placed in accordance with Subsection A of this chapter shall advise motor vehicle traffic of the hours of operation described in this subsection.

Prohibitions/speed limitations. No person shall operate any motor vehicle in excess of 15 miles per hour within a school zone area during the hours of operation as described in this section of this chapter.

§ 375-21 Prohibited right turns on red signal.

No person shall make a right turn when facing a steady red signal at any of the following locations:

§ 375-22 Yield intersections established.

The following intersections, within the Borough of New Cumberland, are hereby declared to be yield intersections, and official yield signs shall be erected (or are hereby confirmed if heretofore erected), at every such intersection in such a position as to face traffic approaching the second-named street in the direction or directions hereby indicated. All vehicles approaching any such intersection upon the first-named street in the direction or directions hereby indicated shall yield to oncoming traffic, within a reasonable distance, before entering such intersections:

§ 375-23 Speed timing devices.

The Police Department of the Borough of New Cumberland and all officers of the said department are hereby authorized to utilize, for purposes of timing the speed of motor vehicles in the Borough of New Cumberland, an electrical device known as VASCAR-plus distributed by Traffic Safety Systems, Inc., of Richmond, Virginia.
