The boundary limits of the Borough of New Cumberland are hereby established as a zone in which motor vehicles may remain standing without lights, and all streets and alleys within such boundary limits are hereby designated as streets where motor vehicles may remain standing without lights.

Any person who violates any provision of this chapter relating to parking regulations shall, upon notice of such violation, pay a fine of $10, provided such fine is paid within 24 hours of the time of the violation, and a fine of $20, if paid within the next 72 hours. If payment is not received within 96 hours, a citation shall be filed before the Magisterial District Judge resulting in a fine, plus the costs of the issuing Authority. Provided: It shall be the duty of the police officers and of parking enforcement personnel of the Borough to report to the Mayor all violations of any provision of this chapter, indicating, in each case: the section violated; the license number of the vehicle involved in the violation; the location where the violation took place; and any other facts that might be necessary in order to secure a clear understanding of the circumstances attending the violation. The police officer or other person making the report shall also attach to or place upon every such vehicle a notice stating that the vehicle was parked in violation of this article. The notice shall contain instructions to the owner or driver of the vehicle as to the above fines and payments thereof, as well as the filing before a Magisterial District Judge, where applicable.

Any person who shall operate a vehicle in violation of the provisions of this chapter shall, upon conviction thereof, be sentenced to pay a fine of 10 plus costs of prosecution and, in default thereof, to imprisonment in the County Jail for not more than five days.

A vehicle shall, for purposes of this chapter, be considered parked when it is left on a street of the Borough for in excess of 15 minutes with no responsible occupant.

For purposes of this chapter, a vehicle is defined as any device in, upon or by which any person or property is or may be transported or drawn upon a public highway.

In making measurements for purposes of this chapter, all distance shall be measured at a 90° angle into the street from the street face of the curb (or edge of paying where there is no curb), or a line projected upward from the street face of the curb (or edge of paying where there is no curb).

Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not less than $25, nor more than $300 together with the costs of prosecution, to be collected as other fines and costs are now being recoverable by law, and in default of payment of the same be imprisoned in the Cumberland County Jail for not more than five days.

The parking of truck tractors with trailers and trailers shall be prohibited on all streets in the Borough of New Cumberland. The parking of truck tractors when not attached to trailers shall not be prohibited, when otherwise permitted by law. For purposes of this chapter a "truck tractor" is defined as a motor vehicle designed and used primarily for drawing other vehicles, and not so constructed as to carry a load, other than a part of the weight of the vehicle and load so drawn. A "trailer" is defined as a vehicle without motive power, designed to carry property or passengers, and to be drawn by a motor vehicle.

For purposes of this chapter, "parking" shall be defined as the standing of a truck tractor with a trailer or a trailer, whether occupied or not, upon the street, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading in front of or making local deliveries to premises situate on said streets, or in obedience to traffic regulations or traffic signs or signals.

Any person, firm or corporation, owner or operator violating any of the provisions of this chapter shall upon conviction before the Mayor of the Borough of New Cumberland or any Magisterial District Judge residing in the Borough of New Cumberland be subjected to a fine of not more than $50 and costs of prosecution and in default thereof shall undergo imprisonment in the Cumberland County Prison at Carlisle, Pennsylvania, for a period not exceeding 10 days.
