That a certain document, one copy of which is on file in the office of the Department of Code Enforcement of the Borough of Lansford, being marked and designated as the "International Mechanical Code, 2006 Edition", as published by the International Code Council, be and is hereby adopted as the Mechanical Code of the Borough of Lansford, in the Commonwealth of Pennsylvania, for regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems as herein provided; providing for the issuance of permits and collection of fees thereof; and each and all of the regulations, provisions, penalties, conditions and terms of said Mechanical Code on file in the office of the Department of Code Enforcement of the Borough of Lansford are hereby referred to, adopted and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 165-31 of this article.

The following sections are hereby revised as follows:

Section 101.1, Insert: Borough of Lansford.

Section 106.5.2, Insert:
Schedule of permit fees. The fees for mechanical work shall be paid as required, in accordance with the Fee Schedule as established by the Borough Council of Lansford by resolution.
C.
Section 106.5.3, Delete: the section.
D.
Section 108.4, (page 5, seventh line)
Insert: Summary Offense
E.
Section 108.4, (page 5, eighth line).
Insert: $300.
F.
Section 108.4, (page 5, ninth line).
Insert: 30 days.
If any section, subsection, sentence, clause, or phrase of this article is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this article. The Borough of Lansford hereby declares that it would have passed this article, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsection, sentences, clauses and phrases be declared unconstitutional.
Nothing in this article or in the International Mechanical Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 3 of this article,[1] nor shall any just legal right or remedy of any character be lost, impaired or affected by this article.
