A. 
Except as allowed under this Section, no person or entity shall burn any material of a combustible nature on that part of any street or property deemed public or City-owned, within the City limits of the City of Verona, Missouri, without a permit.
B. 
Except as allowed under this Section, no person or entity shall burn any material of a combustible nature in the City limits of Verona, Missouri. The burning allowed under this Section is prohibited on any day between the hours of 8:00 P.M. and 6:00 A.M. within the City limits of the City of Verona, Missouri, without a permit. Burning between 6 A.M. and 8 P.M. does not require a permit on any day.
C. 
Definitions. As used in this Section, the following terms shall have these prescribed meaning:
APPROVED CONTAINER
An appliance with fire-resistant walls.
GENERAL BURNING
All burning activity conducted in an approved container.
OPEN BURNING
All burning activity conducted on the ground and not in an approved container.
D. 
Burning Regulations.
1. 
All burning, general or open, of tires, oils, plastics,- or any other hazardous material which gives off toxic emissions through the air, or is a hazard to any person or object, is prohibited.
2. 
Burning in an approved container shall not be conducted within twenty-five (25) feet of any structure or other combustible item or material.
E. 
Paper Products And Solid Waste.
1. 
Open burning of paper products is prohibited.
2. 
All burning of paper products shall be conducted only in an approved container.
3. 
Open burning of solid waste as defined in Section 230.010 is prohibited.
F. 
Open Burning.
1. 
Open burning on the ground shall be allowed for the burning of limbs, leaves, and garden vegetation only, and shall not be conducted within twenty-five (25) feet of any structure or other combustible item or material.
2. 
Open burning of limbs, leaves, and garden vegetation in ditches is prohibited except open burning of leaves only may be permitted in ditches or gutters, if the ditch or gutter is free of weeds, litter, or waste of any kind. The leaves shall be raked into small piles of four (4) feet in diameter or less and shall be maintained at least five (5) feet apart; or the leaves shall be raked into a straight line no wider than two (2) to three (3) feet wide. Piles of leaves are prohibited within twenty-five (25) feet of any item or structure which is of a combustible nature. The leaves shall be burned completely to ashes and shall be burned and maintained in such a manner as not to obstruct drainage.

A garden hose connected to a water supply, hand tools, or other approved fire extinguishing equipment shall be readily available for use at open burning sites.
4. 
Open burning sites shall be attended by a person knowledgeable in the use of fire extinguishing equipment required by this Section; and the person in attendance shall be familiar with the restrictions of open burning. The attendant shall supervise the open burning until the fire has been extinguished.
5. 
Open burning of pile or piles with base diameter in excess of ten (10) feet and height in excess of six (6) feet is prohibited within less than fifty (50) feet of any structure, item or material of a combustible nature. Open burning of pile or piles with base diameter in excess of ten (10) feet and height in excess of six (6) feet shall otherwise be allowed at distances in excess of fifty (50) feet from any structure, item or material of a combustible nature but only if approved by the Aurora Rural Fire Protection District Fire Chief, or his/her appointed representative.

The Aurora Rural Fire Protection District Chief, or his/her appointed representative, is authorized to allow exceptions with respect to the location of general burning and open burning; and the Fire Chief, or his/her appointed representative, is authorized to require that open burning be immediately discontinued if the Fire Chief, or his/her appointed representative, determines that emissions from burning are offensive to occupants of surrounding structures or property, and if the burning is otherwise hazardous because of severe dry conditions, or high winds, in which case the Aurora Rural Fire Protection District Fire Chief, or his/her appointed representative, may declare a City-wide "no fire ban," as defined to mean that no burning of any kind, general or open, is permitted during the time of the "no fire ban." Notification of the "no fire ban" will be accomplished through available communication sources, including newspapers and City officials.
G. 
Permit. All permits shall be issued by the Aurora Rural Fire Protection District Fire Chief or his/her appointed representative. Request for permits are obtained from the Verona City Clerk.
H. 
Nothing in this Section shall restrict individuals from grilling, fire pits, or other small fires for the sole purpose of cooking.
I. 
Violation Of Section. Any person or entity violating any provision of this section shall be deemed guilty of an ordinance violation, and upon conviction thereof, shall be subject to punishment as set forth in Chapter 100, Article III, of this Code.
