There is hereby created and established the office of Assistant City Manager in the government of the City of Garfield.

It shall be the duty of the Assistant City Manager of the City of Garfield to:
A.
Perform such tasks and assume such responsibilities as may be assigned to him/her from time to time by the City Manager.
B.
Act in the place and stead of the City Manager during his/her absence from the City of Garfield, whether such absence is caused by official duties, sickness, leave of absence, or other causes. For the purposes of this chapter and article, "absence" shall not mean or imply being outside of the City's geographic limits as the City recognizes that the City Manager can perform many functions remotely and fully discharge his or her duties. "Absence" for the purposes of this chapter means unable to perform the functions and discharge the duties of City Manager as a result of disability, illness, incapacity, vacation, leave of absence, personal day off, or by such designation by the City Manager.
C.
The Assistant City Manager, when acting in the place and stead of the City Manager as set forth in Subsection B immediately above, shall be limited to making only day-to-day decisions, but shall not have the authority to enter into or amend any binding agreement with a third party, authorize any expenditures, cancel or void any existing agreements or contracts, enter into or amend any collective bargaining agreement governing City employees, authorize the settlement or resolution of any legal dispute involving the City, impose discipline upon a City employee pursuant to the New Jersey Civil Service Act, alter any provision or term of any employee benefit plan, or hire, appoint or remove any employee or department head without the express written approval of the City Manager.
D.
Whenever the City Manager is designated by ordinance to conduct a hearing or render a decision thereon, the City Manager may designate the Assistant City Manager to conduct such hearing or to render a decision thereon in his/her absence. In conducting such hearing or in reaching a decision thereon, any action taken by the Assistant City Manager so designated shall have the same effect and validity as if taken by the City Manager.
The Assistant City Manager shall be appointed by and hold office at the pleasure of the City Council. The employee holding the office of Assistant City Manager shall constitute the individual appointed by Council to exercise the powers and perform the duties of the office of the City Manager during the absence or disability of the City Manager, pursuant to N.J.S.A. 40:82-6.
The Assistant City Manager shall receive such salary as shall be provided in the annual Salary Ordinance of the City of Garfield.
