The Supervisors of Moore Township, Northampton County, Pennsylvania, under the powers vested in them by the "Second Class Township Code" and the "Pennsylvania Municipalities Planning Code," as amended,[1] as well as other laws of the Commonwealth of Pennsylvania, do hereby ordain and enact the following.

No person shall operate and no owner shall permit the use of brake retarders on the following two sections of SR 0512:
A. 
From the intersection of SR 0512 and Woodsedge Road north to the intersection of SR 0512 and Jones Road.
B. 
From a point 300 feet north of the intersection of SR 0512 with Keeler Road north to a point 945 feet north of the intersection of SR 0512 with Bauer Road.
Upon conviction before a Magisterial District Judge, the person or persons found guilty shall pay a fine as follows:
A. 
First offense: $100;
B. 
Second offense: $250;
C. 
Third offense: up to the sum of $1,000 and/or 30 days in prison in accordance with the Pennsylvania Rules of Criminal Court for summary proceedings.
If any section, clause, provision or portion of this article or regulation incorporated herein shall be held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect any other section, clause, provision or portion of this article or regulation.

A. 
From the Township line east to the intersection of SR 946 and Hoch Road.
If any section, clause, provision or portion of this article or regulation incorporated herein shall be held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect any other section, clause, provision or portion of this article or regulation.
Any person who shall violate any provision of this article shall, upon conviction thereof, pay a fine as follows:
A. 
First offense: $100;
B. 
Second offense: $250;
C. 
Third offense: $1,000 and/or 90 days in prison in accordance with the Pennsylvania Rules of Criminal Court for summary proceedings.
