The purpose of the annual safety inspection program is to ensure that business and commercial operations within the city are operating in compliance with applicable federal, state and local regulations to protect the health, safety, and welfare of the city by reducing the risk of the occurrence of dangerous incidents, including fires, explosions, nuisances, and other catastrophes.

The following business and commercial operations within the city, including those currently existing and new operations, shall be subject to an annual inspection by the inspection official to ensure the operation is in compliance with the applicable federal, state, and local regulations that govern the operation:
(1) 
Hydrocarbon well operations.
(2) 
Commercial business operations.
(3) 
Food establishment operations.
(4) 
Rental properties.

If an operator of an operation subject to this article is found to be noncompliant during the annual inspection, the city shall give written notice to the operator specifying the nature of the failure and giving the operator a reasonable time to cure, taking into consideration the nature and extent of the failure and the extent of the efforts required to cure. In no event, however, shall the cure period be less than fifteen (15) days. It shall be a violation for the operator to fail to correct the noncompliance within the cure period.

The operator of an operation subject to an inspection under this article shall pay an inspection fee as prescribed in the fee schedule adopted by the city council and amended from time to time. Failure to pay the fee required for an inspection under this article shall be a violation.

A violation of this article shall be an offense punishable by a fine in accordance with the general penalty provided in section 1.01.009 of this code.
