Any decision rendered by the code enforcement officer under this article may be appealed to the city council by any person, agent, or representative affected by such decision. Such appeal must be received within ten (10) days after the placement of a letter in the U.S. mail addressed to the address on the permit or the address of the current owner of record in the county tax records which states the written decision which has been rendered by the code enforcement officer. Such appeal shall be filed in writing with the code enforcement officer specifying the grounds on which the appeal is based. The code enforcement officer shall forthwith transmit to the city council all documents pertaining to the appealed action. The city council shall hear the appeal at a city council meeting as soon as practicable thereafter to determine whether the decision of the building official was in accordance with all ordinances and regulations. The decision of the city council shall be final.

The city council may authorize variances to any restriction set forth in this article, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the city council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self-imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this article. A person may request a variance from this article by filing the request with the code enforcement officer. Any request for variance shall be accompanied by a completed application and a nonrefundable filing fee in the amount specified in the current fee schedule adopted by the city council.
