There shall be a Board of Health in the Borough consisting of seven members appointed by the Mayor, with the advice and consent of the Council, for terms of three years, except that the members first appointed shall serve for staggered terms. At least one member shall be a physician residing or practicing in the Borough. Appointments to fill vacancies shall be made in the same manner as original appointments, and all such appointments shall be for the unexpired term only.

The Board of Health shall have the power and authority to adopt ordinances relating to the protection of the health of Borough residents, shall employ necessary personnel and fix their salaries and shall appoint the local Registrar of Vital Statistics of the Borough, the Health Officer and such other employees as are necessary to carry out its duties. The Board of Health shall have all the jurisdiction conferred upon boards of health by Title 26 of the New Jersey Statutes.

A. 
The Mayor, with the advice and consent of the Council, shall also appoint two alternate members to the Board of Health who, at the time of their appointment, shall be designated as "Alternate No. 1" and "Alternate No. 2." The terms of the alternate members shall be for two years, except that the terms of the alternate members first appointed shall be two years for Alternate No. 1 and one year for Alternate No. 2, so that the term of not more than one alternate member shall expire in any one year. A vacancy occurring otherwise than by the expiration of a term shall be filled by the Mayor, with the advice and consent of the Council, for the unexpired term only.

B. 
An alternate member shall not be permitted to act on any matter in which he has, either directly or indirectly, any personal or financial interest. An alternate member may, after a public hearing if he or she requests one, be removed by the Mayor and Council for cause.
C. 
An alternate member may participate in discussion of the proceedings but may not vote except in the absence or disqualification of a regular member. A vote shall not be delayed in order that a regular member may vote instead of an alternate member. In the event that a choice must be made as to which alternate member is to vote, Alternate No. 1 shall vote first.

Any Board member who fails to attend more than three regularly scheduled meetings during any twelve-month period shall be deemed to have resigned his or her membership on the Board, thereby creating a vacancy which shall be filled for the unexpired term by appointment of the Mayor with the advice and consent of the Council. Nothing herein shall prevent the reappointment of the same individual, at the discretion of the Mayor and Council.
