(a)
The residential green building program sets the minimum standards for energy efficiency, conservation of water, indoor air quality, and waste recycling for all single-family residential buildings platted after May 23, 2001. The minimum standards required for all single-family residential buildings and structures for which an application for a building permit is filed after June 30, 2007, are set forth in Exhibit A, which is attached to Ordinance 06-10-111 and incorporated as if fully set forth herein. The existing standards, adopted by Ordinance 01-05-39, shall continue to apply to lots platted after May 23, 2001, and for which a building permit application is filed before July 1, 2007.
(b)
Any person, firm, corporation or entity violating this article shall be deemed guilty of a misdemeanor, and upon conviction therefore, shall be fined a sum not exceeding $500.00 or fined a sum not exceeding $2,000.00 for violations related to public health, public sanitation, or refuse dumping, and each and every day that such violation continues shall be considered a separate offense; provided, however, that such penal provision shall not preclude a suit to enjoin such violation. Frisco retains all legal rights and remedies available to it pursuant to local, state and federal law.
