For purposes of article, the following terms shall apply:
Public place.
Any place to which the public or a substantial group of the public has access or view and includes but is not limited to streets, alleys, highways, common areas of schools, hospitals, apartment houses, office building, transport facilities, shops, yards, parks, sporting facilities plazas, and structures.
Restroom.
A location with toilets or urinals for the purpose of urinating or defecating.

It is a defense to prosecution under this article if the person was in a restroom.

Any person, firm, corporation or business entity violating this article shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined a sum not exceeding $500.00. Each continuing day's violation under this article shall constitute a separate offense. The penal provisions imposed under this article shall not preclude the city from filing suit to enjoin the violation. Frisco retains all legal rights and remedies available to it pursuant to local, state and federal law.
