A. 
The use of all four-wheeled, hand-propelled, commercial-type grocery carts upon the streets or sidewalks of the Village of Uplands Park is hereby prohibited.
B. 
The term "cart" or "carts", or "grocery cart" or "grocery carts", as used in this Section, shall mean and refer only to four-wheeled, hand-propelled, commercial-type grocery carts.
C. 
It shall be unlawful for any person to abandon any grocery cart within the Village of Uplands Park.
D. 
Whenever any Police Officer or other officer or official of the Village observes what appears to be an abandoned cart within the meaning of this Section within the Village, he/she shall notify the Village Marshal who shall cause the same to be removed from its location and impounded and stored in a place of safe-keeping designated by the Board of Trustees or Chairman of the Board.
E. 
The Village Marshal shall notify the Village Clerk of such fact and if the name of the owner of any such cart can be ascertained, the Village Clerk shall notify the owner thereof in writing, of such impoundment and storage, requesting the owner thereof to take possession of such cart upon paying the charges hereinafter set forth. Such notice shall set forth the date of impoundment, the daily storage charge, the fee for redemption, the time and place where said cart can be redeemed, and that if not redeemed within fifteen (15) days from receipt of notice, such cart will be sold as provided for in the Section.
F. 
The term "abandoned" wherever used in this Section as relating to grocery carts, shall apply to any such cart left within the Village on any Village street or sidewalk or unpaved sidewalk area or on any public property or easement unattended and for such time and under such circumstances as to cause such cart reasonably to appear to have been abandoned.
G. 
A redemption charge shall be collected from the owner by the Village Clerk in the sum of five dollars ($5.00) per cart to cover the cost of picking up and transporting such cart to a place of safekeeping, and an additional charge of three dollars ($3.00) per day per cart for storage. Said storage charge of three dollars ($3.00) per day shall commence on the next day (Sundays and legal holidays excluded) after the owner receives the written notice required by this Section. Upon the payment of all charges the Clerk shall turn over possession of such cart to the owner.
H. 
In the event the Village Marshal or Village Clerk is unable to ascertain the owner of any abandoned cart, such cart shall be deemed to be lost and unclaimed property within the meaning of Chapter 447, RSMo., 1969, and shall be dealt with as provided therein.
I. 
In the event the owner of any abandoned cart shall fail to redeem the same within fifteen (15) days after receipt of the notice required by this Section, such cart shall be sold at public auction and the proceeds from such sale shall be turned over to the Village Treasurer for deposit in the General Revenue Fund. Provided however, that such public auction shall be advertised for three (3) weeks immediately preceding such auction sale by three (3) consecutive insertions in a weekly paper, or one (1) insertion each week for three (3) consecutive weeks in a daily newspaper having general circulation in the Village or in the County of St. Louis.
J. 
The notice required by this Section shall be served on the owner of the abandoned cart, personally or by registered or certified mail return-receipt. If the owner is a corporation, service of such notice personally or by registered or certified mail return-receipt, upon any agent, or employee of such corporation at any store or business office where such corporation is doing business shall satisfy the requirements of this Section.
