A. 
Whereas, this Township, pursuant to 53 P.S. § 66527, Act of May 1, 1933, P.L. 103, No. 69, as amended, has the authority to adopt ordinances necessary for safety and general welfare in the Township; and
B. 
Whereas, this Township, pursuant to Section 6109(a)(1) of the Vehicle Code of the Commonwealth of Pennsylvania, Act of June 17, 1976, P.L. 162, as amended,[1] has the authority to impose regulations regulating or prohibiting stopping, standing or parking on streets and highways within its boundaries and imposing speed limits; and

C. 
Whereas, no parking restrictions on certain streets located in Southampton Township are necessary due to safety and other issues; and
D. 
Whereas, traffic studies, where required, have been performed by the Township Engineer, and
E. 
Whereas, Section 6301 of the Pennsylvania Motor Vehicle Code, 75 Pa.C.S.A. § 6301, authorizes a municipality to, if it elects, accept the payment of a penalty, in lieu of prosecution, for violation of local ordinances relating to parking, under conditions prescribed by the municipality;
F. 
Now, therefore, be it enacted and ordained and it is hereby adopted by the Board of Supervisors of Southampton Township as follows:
For purposes of this article, the following definitions apply:
CARTWAY, ROADWAY, STREET
That portion of a highway, improved with a macadam wearing course, and designed for vehicular travel, exclusive of the sidewalk, berm or shoulder.
Except as in § 324-8 below, it shall be unlawful to park or place any motor vehicle or other mode of transportation or object or structure on the paved portion of any of the following streets located in Southampton Township, Cumberland County, Pennsylvania, including the following streets as well as any future streets dedicated to the Township:

Except as in § 324-8 below, it shall be unlawful to park or place any motor vehicle or other mode of transportation or object or structure on the paved portion of any other cartway, roadway or street not listed in § 324-5 above that is located in Southampton Township, including, but not limited to the following streets as well as any roads dedicated to the Township in the future: Means Hollow, Koser Lane, Cherry Grove, Peiper, Fish Hatchery, Mud Level, Fogelsanger, Smithdale, Walnut Dale, Stonewall, Gephart, Whitmer, Whitehouse, Hershey, South Mountain Estates, Cramer, Gutshall, Goodhart, Strohm, Chestnut Grove, Broad Street, Sand Bank, Holtry, Naugle, Brown, Ott, Clouse, Springfield, Middle Spring, Hale, Furnace Hollow, McClays Mill, Chamberlin, Airport, and Neil Roads.
Notwithstanding the above, a motor vehicle may be parked to the outside of any fogline that has been or will be placed on any cartway, street or roadway.
The appropriate Township officials and/or employees are hereby authorized to place restrictive signs designating the area described in sections above as a "no parking" zone in accordance with regulations of the Pennsylvania Department of Transportation.

A. 
Any person who owns, operates, or parks a vehicle that interferes with the normal movement of traffic or creates a safety hazard shall promptly cause the vehicle to be moved so as to eliminate the interference or hazard. In the event the owner or operator is unable, unwilling or otherwise fails to promptly remove the vehicle, the person shall be deemed to have authorized Southampton Township or its contractor to act as the person's agent to promptly remove the vehicle on the person's behalf to a place of storage, and such person shall be liable to the person providing the removal and storage services for the cost thereof.
B. 
The Township shall promptly send notice by certified mail to the last registered owner of the vehicle advising where the vehicle is located and that it may be reclaimed upon payment of costs. If the abandoned motor vehicle does not bear an identifiable registration plate, current certificate of inspection or vehicle identification number plate, the notice may be secured to the vehicle.
C. 
The owner of the vehicle shall have the right to a hearing before the Board of Supervisors for Southampton Township if the owner claims that the vehicle was parked legally.
A. 
Except as set forth below, any person or entity violating §§ 324-6 and 324-7 of this article shall be guilty of a summary offense, and shall, upon conviction, be sentenced to pay a fine not to exceed $1,000 or, upon failure to pay, imprisonment, in accordance with the Pennsylvania Second Class Township Code, 53 P.S. § 66601(2).
B. 
The Township's Zoning/Codes Enforcement Officer shall issue a ticket relating to an alleged violation of this article. In lieu of prosecution, an alleged violator shall pay a penalty of $20 to the Township, to be received by the Township within five business days of the issuance of the ticket. If the penalty is not paid within five business days, the alleged violator shall pay $40 within the next five business days occurring after the initial period of five business days to avoid prosecution. If an alleged violator does not pay the penalty as prescribed above, then the Township shall proceed to prosecution as set forth above.
All other ordinances or parts of ordinances inconsistent herewith shall be and the same are expressly repealed.
In the event that any provision, section, sentence, clause, or portion of this article shall be held to be invalid, such invalidity shall not affect or impair any remaining provision, section, sentence, clause or portion of this article, it being the intent that such remainder shall be and shall remain in full force and effect.
