A. 
Cattle, sheep, goats, llamas/alpacas, horses, fowl (including roosters and chickens, except egg-laying chickens provided for in § 163-16 of this article), pot belly pigs. mules, asses, or exotic animals are prohibited in the City.
B. 
No person shall keep or maintain any cattle, sheep, swine, goats, llamas/alpacas, horses, fowl, including roosters and chickens, except egg-laying chickens provided for in § 163-16 of this article, pot belly pigs, mules, asses, or exotic animals within the City, except on properties and/or by property owners owning such animals prior to the date of this article amendment and that meet all prior requirements of Chapter 163, the City of Nanticoke Zoning Ordinance, and any public health requirements of the City of Nanticoke.
C. 
For the purposes of this section. exotic animals shall be defined as animals or reptile species that are typically not kept as pets and are wild and not indigenous to this locale.
The prohibition against the maintenance of animals set forth above shall not apply to certified emotional support or service animals. Owners must have a certificate from a recognized emotional support or service animal related agency evidencing the completion of relevant training in order to be considered exempt.
A. 
Notwithstanding the foregoing prohibition against fowl, including roosters, egg-laying chickens/hens shall be permitted within the Nanticoke City limits subject to the terms and conditions of this article.
B. 
Residents shall not be allowed to possess or maintain more than six egg-laying chickens/hens on their property at any given time and egg-laying chicken/hen-owning residents shall be required to have fencing on their property in order to prevent the animals from roaming at large. Owners will be subject to fines and penalties as set forth herein if their egg-laying chickens/hens are found to be roaming outside of their owner's property lines.
C. 
Coops for the egg-laying chickens/hens shall be located no closer than 10 feet from any property line and shall be kept in clean condition in accordance with § 163-18 below. Failure to do so shall subject the owner to fines and penalties as set forth herein, and an order to remove the chickens/hens.
D. 
Residents seeking to own egg-laying chickens/hens on their property shall be subject to a registration fee of $50 payable to the City of Nanticoke. Failure to pay the registration fee shall prohibit ownership and subject owners to fines and penalties for violation of this article as set forth below.
Unless as otherwise provided for herein, any persons who owned cattle, sheep, swine, goats, llamas/alpacas, horses, fowl, pot belly pigs, mules, asses, or exotic animals within the City who prior to the enactment of this article were permitted to maintain ownership, may not replace such animals which are sold or are later deceased.
A building or coop in which animals, including hens, are kept must always be kept thoroughly clean and shall be cleaned at least once every week and more often if the City Code Officer so requires. All refuse or anything foul or obnoxious must be removed at least twice a week, and all coops, pens or stables must be thoroughly disinfected at least once every week and more often if the City Code Officer so requires.
Any person who shall violate any provision of this article, upon conviction thereof, shall be sentenced to pay a fine of not more than $100 plus costs or to a term of imprisonment not to exceed 90 days or both. Each animal kept in violation of this article constitutes a separate violation. Each day that a violation of this article continues shall constitute a separate offense.
