Editor’s note–Former section 6.02.007 pertaining to the property advisory and appeals board and deriving from Ordinance 2007-11-52 adopted 11/12/07, was superseded by Ordinance 2018-12-53 adopted 12/10/18. Similar provisions can now be found in section 5.02.013.
No person, corporation or entity shall conduct work for hire under any building, plumbing, mechanical, electrical, or sign permits under the Code of Ordinances in the city without first being registered with city as provided in this article.

The following information must be submitted on a form promulgated at the time of registration:
(1) 
A completed contractor’s registration form, signed by the owner, managing partner or chief executive officer of the contractor.
(2) 
A legible copy of the driver’s license of the owner, managing partner or chief executive officer who signs the registration form.
(3) 
Home builders must submit a copy of their state residential construction commission registration certificate.
(4) 
A registration fee as established by resolution of the city council.
(5) 
All registrations expire one (1) year from the date of issuance.
(6) 
General liability insurance in the minimum coverage amount of five hundred thousand dollars ($500,000.00). The city must be named as the certificate holder.

A contractor’s registration may be denied, suspended or revoked by the city manager or designee for any of the following reasons:
(1) 
The contractor fails to finalize permits by obtaining the required inspections.
(2) 
The contractor allows use or occupancy of a structure for which a permit was obtained without first obtaining the required certificate of occupancy.
(3) 
The contractor has performed substandard work.
(4) 
Abandonment of a construction project.
(5) 
The prior abandonment of one or more construction projects by a contractor or any owner, partner or an officer of the contractor.
(6) 
A finding of fraud or deceit in securing a registration or a permit.
(7) 
Conviction in municipal court of three (3) or more violations of any of the provisions of the building code committed within a period of twelve (12) consecutive months.
(8) 
Accumulation of two (2) decisions of the board to suspend registration.
(9) 
Accumulation of three (3) stop work orders within a period of twelve (12) months or two (2) forfeitures or failure to appear at an appeal of stop work orders.

(a) 
A person who has received a denial, suspension or revocation may request an appeal of the city manager or designee’s decision to the property advisory and appeals board.
(b) 
The board shall conduct the hearing on any proposed denial, suspension, or revocation of a contractor’s registration.
(c) 
The contractor shall be notified by mail ten (10) days prior to the hearing date.
(d) 
Should the contractor fail to appear at the scheduled time for the hearing, the board may proceed to hear the case.
(e) 
During the period of time preceding the hearing, the contractor may not secure a permit for work or register under any different identification or corporate entity or other organization.

All fees established by this article shall be set by the appropriate resolution of the city council.

Revocation of registration shall be a full and final cancellation of such registration and shall be effective immediately after the expiration of the time period for an appeal to the property advisory and appeals board, if no appeal is timely made, or upon the final decision of the property advisory and appeals board after an appeal is provided. A contractor whose registration is revoked shall not be allowed to reapply for a registration for a period of two (2) years.
