The establishment, operation or maintenance of a commercial pool hall within the city limits is hereby prohibited.

Commercial pool hall is meant to and does include any commercial establishment wherein one (1) or more pool tables are operated or displayed for operation by the public or any members thereof, whether for hire or not, but such term is not meant to and does not include the operation or use of a pool table in a private home or private club not open to members of the public generally, or by any beneficent, fraternal, religious, educational, eleemosynary or philanthropic institution or organization which shall operate or use such pool table or tables for the recreation and amusement of its members and guests without making a charge or collecting a fee for the operation or use thereof.

Violation of this article shall constitute a misdemeanor, which, upon conviction therefor, shall be punishable by fine in accordance with the general penalty provision found in section 1.01.009 of this code.
