Temporary structures used for commercial or retail purposes
are permitted only as expressly provided in this section: No temporary
structure shall be established unless a temporary certificate of occupancy
evidencing the compliance of such use with all applicable provisions
of this code of ordinances and regulations has first been issued.
Any temporary structure used for commercial or retail purposes must
be an industrialized building possessing a valid seal or insignia
pursuant to the Texas Industrialized Housing Building Program (IHB)
or its successor program.

(a) A
real estate sales office is permitted in any residential district
for any new subdivision approved in accordance with the city subdivision
ordinance. The office may not contain sleeping or cooking accommodations.
(b) A
model home may be used as a temporary sales office for the duration
of the temporary certificate of occupancy in any residential district
for any new subdivision approved in accordance with the city subdivision
ordinance.
(c) The
maximum length of any permit or temporary certificate of occupancy
shall be one (1) year. Additional permits or temporary certificates
of occupancy may be granted by the building official or public works
director.
(d) The
office shall be removed upon completion of the development of the
subdivision.

Temporary structures used for commercial or retail purposes
for use in connection with the development of residential property
in a planned development district shall be permitted on the land of
the project during the construction period. Temporary structures related
to a subdivision development or the development of residential property
shall be removed when construction ceases for a period of three (3)
consecutive months.

When fire or natural disaster has rendered a permanent structure
used for commercial or retail purposes unfit for human habitation,
the use of a temporary structure located on the lot during rehabilitation
of the original structure or construction of a new structure is permitted
subject to the following additional regulations:
(1) Required
water and sanitary facilities must be provided.
(2) Maximum
length of permit shall be twelve (12) months, however the building
official or public works director may extend the permit for a period
or periods not to exceed 60 days in the event of circumstances beyond
the control of the owner. Application for the extension shall be made
at least 15 days prior to expiration of the original permit. In no
case shall the length of the original permit plus all extensions exceed
(18) months.
(3) The
temporary structure shall be removed from the property within thirty
(30) days upon issuance of any occupancy permit for the new or rehabilitated
structure.
