As used in this division, the term “center” shall mean the Sherman Youth Center located on a tract of land at the northeast intersection of the Access Road and Washington Street, and the Kerr-East Complex located at and including Kerr Park located on Kerr and East Streets, such term to include structures, grounds, parking areas, furnishings and equipment at those locations. The term “center supervisor” shall mean the center supervisor of the Sherman Youth Center and the Kerr-East Complex.

The center shall be supervised and managed by the city’s designated representative known as the center supervisor of the center, who reports to the city manager or his representative.

The primary use of the center is for wholesome, planned recreation for the citizens of the city.

The general rules of conduct of persons using the center shall be as follows:
(1) 
The consumption of alcohol prior to or while in attendance at the center or possession of alcohol on the premises of the center is strictly forbidden.
(2) 
All forms of wagering or gambling on the center premises are strictly forbidden.
(3) 
Any ungentlemanly or unlady-like conduct, which includes foul language, unnecessary loudness or loitering, is strictly forbidden.

(a) 
The center may be rented in accordance with the following rules and regulations:
(1) 
The rental is not in conflict with an established program.
(2) 
Reservations are made two (2) weeks in advance and the rental fee is paid prior to the usage.
(b) 
The charges for use of the center shall be such as are established from time to time by the city council.
(c) 
A deposit of fifty (50) percent of the rental fee prescribed above shall be made at the time of the reservation, and shall be considered as liquidated damages if the use is not completed. The rental fee shall be considered a contract with the city obligating the licensee to repair or replace any damaged property during the rental period and provided the lessee shall compensate any personnel required which is more than the normal personnel of the center. Decorations are to be allowed as specified by the supervisor, and no liability shall be attached to the city for the decorations.

The hours of operation of the center shall be those necessary for operation of established programs as established by the city council.

The supervisor shall have the authority to enforce all rules and regulations that are necessary for the operation of the center, provided that such rules and regulations shall not conflict with the laws of the state, the charter of the city, or this division or other ordinances of the city. The rules and regulations enforced by the supervisor shall be approved by the city manager or his representative.

Any decision made or action taken by the supervisor of the center may be appealed in writing to the city manager or his representative by any person feeling aggrieved thereby after the decision or action is taken and not more than twenty-one (21) days thereafter. The absence of an appeal shall cause the supervisor’s ruling, decision or action to become final, and in the event of such appeal, the city manager’s or his representative’s action thereon shall become final.

(a) 
A person commits an offense if he is in possession of a burning tobacco product or smokes tobacco in the youth center of the city at any time. It is a defense to prosecution under this section that:
(1) 
There is not located in said establishment a prominently displayed sign of reasonable size giving notice that smoking is prohibited by ordinance and that the offense is punishable by fine and not to exceed two hundred dollars ($200.00); and
(2) 
The room is not equipped with facilities for extinguishment of smoking materials.
(b) 
Any individual violating any of the provisions of this section shall be deemed guilty of a misdemeanor and, upon final conviction thereof, fined in accordance with subsection (a)(1). Each and every day any such violation continues shall be deemed a separate offense and is punishable as such hereunder.
