(a) 
In accordance with 40 CFR 2, and 40 CFR 403.14, any information submitted to the city pursuant to this division may be claimed as confidential by the industrial user, if this information is not considered effluent data as defined by 40 CFR 2.302.
(b) 
Any such claim must be asserted at the time of submission in the manner prescribed on the application form or instructions, or, in case of other submissions, by stamping the words “confidential business information” on each page containing such information. The user must be able to demonstrate to the satisfaction of the city manager that the release of such information would divulge information, processes, or methods of production entitled to protection as trade secrets under applicable state law.
(c) 
If no claim is made at the time of submission, the city may provide the information to the public without further notice.
(d) 
If a claim is asserted and meets the provisions of subsections (a) and (b) above, the information will be treated in accordance with procedures specified in 40 CFR 2 (Public Information) and will be made available to TCEQ and/or EPA upon request
