(a) 
Any non-domestic users subject to the reporting requirements established in this division shall be required to retain and make available upon request for inspection and copying by the city, records that include, but are not limited to:
(1) 
Monitoring information, including calibration and maintenance records, laboratory reports, self-cleaning logs, standard operating procedures, training records, and any other record of data required to determine compliance with this division. These records shall be retained for a period of at least three (3) years from the date of the sample, measurement, or activity.
(2) 
Manifests or other records of information pertaining to the generation, transporting, and disposal of liquid wastes. These records shall be retained for a period of at least five (5) years.
(b) 
The periods of record retention may be automatically extended for the duration of any unresolved litigation concerning compliance with this division, or extended at any time by request of the city.
(c) 
All records subject to enforcement or litigation activities brought by the city shall be retained and preserved as defined in section 13.07.510(a) of this article.

(a) 
Written reports or correspondence submitted to the city shall be deemed submitted on the date postmarked. For reports or correspondence which is not mailed, postage paid into a mail facility serviced by the United States Postal Service, the date of receipt by the city shall govern.
(b) 
All reports and correspondence required by this division shall be submitted to the city at the mailing address provided in the FOG control program.

When requested by the city manager, non-domestic users must submit information on the nature and characteristics of their wastewater operations by completing a wastewater questionnaire or similar form developed by the city. Failure to complete and return this questionnaire or survey shall constitute a violation of this division.

The city manager may develop standardized forms for the non-domestic user to submit information required in this division. The user shall use these standardized forms unless authorized otherwise. These forms may be updated as needed.

(a) 
Non-domestic users shall furnish to the city, within the prescribed time period, any information which the city may request to determine compliance with the requirements of this division unless stated otherwise in this article.
(b) 
Non-domestic users shall notify the city in writing, prior to the prescribed due date, if additional time is needed to submit records, reports, or correspondence requested by the city. The city will approve these extensions on a case-by-case basis only.

The city may require non-domestic users to develop and implement a FOG control plan where necessary to document how the user will comply with the requirements of this division.
(1) 
If the plan submitted by the user is inadequate, the city may require subsequent modifications.
(2) 
Once the user submits the plan, the city will provide the user with written notice of its acceptance.
(3) 
Failure to implement any element of an accepted plan is a violation and may subject the user to enforcement remedies described in this division.
