As used in this article, the following terms shall have the meanings indicated:
SATELLITE ANTENNA
Any apparatus which is designed for the purpose of receiving television, radio, microwave satellite or similar signals, with the exception of conditional and conventional television antennas.

No satellite antenna, including its mount, shall be built, erected or modified unless a building permit is issued by the construction official. Any person (which shall include corporations, partnerships, associations or any other legal entity) applying for such a permit shall furnish to be construction official such plans, drawings and specifications as he may reasonably require as to the satellite antennas to be constructed, erected or modified and shall pay a fee established by Borough Council pursuant to § 360-47A.
All satellite antennas shall be deemed accessory buildings as said term is defined in the Code of the Borough of Barrington and shall be subject to all regulations set forth in said Code governing the location and height of accessory buildings. Any inconsistencies between this section and the other sections of this Zoning Chapter will be resolved in favor of this article.
The satellite antenna, commonly known as a "satellite dish," is permitted in all zones as a conditional use after the following requirements are met:
A. 
A satellite antenna is permitted as an accessory use on a lot which contains a principal structure, residence and/or business.
B. 
A satellite antenna is not permitted in the front of any structure. In the case of a corner lot (which by definition has two front yards), a satellite antenna may only be located in that quadrant of the lot situated behind both rear lines of the structure.
C. 
No lot may contain more than one satellite antenna as heretofore regulated, which shall be set back a minimum distance of at least 10 feet from rear and respective side property lot lines.
D. 
Apartments, townhouses and multi-dwelling units shall be permitted no more than one satellite antenna per complex or development, irrespective of the number of lots within said complex or development.
E. 
Satellite antennas may be used only for receiving signals and shall not be used for the transmission of signals.
F. 
No satellite antenna placed anywhere on any lot shall exceed a height of 12 feet or exceed 12 square feet of antenna surface, unless it can be demonstrated that, due to the uniqueness of a piece of property, no satellite antenna of the height or size enumerated could be installed to provide adequate reception for the property.

G. 
The structure must be screened, buffered or situated in such a manner that it cannot be visually seen from the public right-of-way abutting the lot on which the structure is situated.
H. 
No satellite antenna is permitted on the roof or any other portion of the dwelling in any residential and commercial districts.
I. 
If the satellite antenna is to be placed on a side yard due to inaccessibility of a rear yard, it is to conform to the same regulations as are required for principal buildings in the Code of the Borough of Barrington.
The Zoning Official of the Borough of Barrington is hereby designated as the public officer charged with the enforcement of the terms of this article. All complaints for alleged violation of any terms of this article shall be submitted, in writing, to the said Zoning Officer.

Any person, firm or corporation or his, her or its agent, servant, representative or employee violating any of the provisions of the Article shall be subject to the penalties provided in Chapter 1, Article I, General Penalties. Each day's continuance of a violation of any of the provisions of this article shall be deemed a separate and distinct offense and shall be punishable accordingly.

This article is a zoning regulation. Relief from the terms herefore shall be effected by application for variances from terms of this article presented to the Planning Board of the Borough of Barrington by utilizing the same procedures set forth for variance application under the terms of the Borough Code of the Borough of Barrington and N.J.S.A. 40:55D-1 et seq. and the rules and regulations of the Planning Board.
