Applicant.
A person who applies for a permit, and includes all persons residing at the address of the location where the temporary sale is to be held.
Garage sale.
A temporary sale as defined herein.
Location.
The place where a temporary sale is to be conducted.
Temporary sale.
One (1) sale of tangible personal property at retail not exceeding three (3) consecutive days in length for each sale during any twelve-month period carried on at a home or residence by a person who does not hold himself out as engaging in or who does not habitually engage in the business of selling such tangible personal property at retail and who does not carry on such sale or sales in such a manner as to create a disturbance or become a nuisance to the neighborhood, and only so long as such person is selling only personal property that belongs to him personally and has not been purchased for the purpose of resale. No more than two (2) signs shall be posted on any residential property advertising such sales, and no such sign shall exceed a size of two hundred eighty-eight (288) square inches.
Yard sale.
A temporary sale as defined above.

(a) 
The only way to regulate such sales in the opinion of the city council is for each individual desiring to have a sale apply for and receive in advance of sale a permit. All temporary sales, including garage sales, yard sales and other sales, shall require a permit from the city. All permits issued hereunder shall be issued upon application and payment of a fee provided for in the fee schedule in chapter 1, article 1.50 of this code to the city secretary.
(b) 
Any person who desires a permit to conduct a temporary sale shall make an application, in writing, to the city secretary. All applications shall contain the following information:
(1) 
Name and residence address of the applicant.
(2) 
Beginning and ending dates of temporary sale.
(3) 
General type of goods, wares and/or merchandise to be offered for sale (furniture, clothing, etc.).
(4) 
The hours that such temporary sale shall be conducted each day.
(5) 
Location of the sale (this location must be the same as the residence address of the applicant).
(6) 
What traffic hazards, or other problems, that the applicant believes may arise.
(c) 
All permits issued hereunder shall be valid for no more than three (3) days and shall be for the same days as shown on the application.
(d) 
No more than one (1) permit shall be issued for a temporary sale to be conducted on any location, or address, during a twelve-month period unless special permission for an additional sale is specifically granted by the city manager. The twelve-month period shall be from the date of issue of the first permit to a location.
(e) 
Bad weather deferral may be granted by the city secretary with no additional fee.

Nonprofit, religious and civic organizations are exempt from a permit fee. Permit applications are required, and site selection must be approved. Furthermore, sites must be on commercial or church premises.
