The water conservation and drought contingency plan attached to Ordinance 2024-1312 as exhibit A is hereby adopted and the regulations contained therein are subject to enforcement as if set out in full and made a part of this article.

The city manager or his designee shall have the authority to implement the applicable water conservation/drought contingency plan described in section 22.10.031 when the water supply or the capacity of the water system to deliver water is approaching levels which, in the judgment of the city manager or his designee, will inhibit the ability of the city to deliver a necessary amount of water to each water customer.

The city manager or his designee shall issue public announcements in the news media as to what phase of the water conservation/drought contingency plan is in effect. The public announcements shall include a description of the provisions in effect.

Every owner, occupant, tenant or lessee may file a written application with the city manager or his designee for a special use permit to use water in a manner inconsistent with the water conservation/drought contingency plan during a water use restriction period by following the procedures in section 7.7 of exhibit A adopted by this division. The city manager or his designee shall have the authority to issue an emergency temporary permit pending the approval of the special use permit. Any person denied a special use permit or an emergency temporary permit may appeal such denial to the city council. In no event shall the permit be effective more than two weeks from the date of issuance. Each special use permit application shall be accompanied by a nonrefundable permit fee of $25.00.

A person commits an offense under this division or any section hereof if such person dispensed water, directed the dispensing of water, or failed to discontinue the dispensing of water contrary to the provisions of this division or any section hereof. It shall not be necessary for the city to present a witness who actually saw water being dispensed if the circumstances indicate that water was dispensed at a particular location in violation of the provisions of this division or any section hereof.

Any person violating any of the provisions of this division shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in a sum not to exceed $2,000.00 for each offense relating to fire safety and $500.00 for all other violations. A separate offense shall be deemed committed upon each day during or on which a violation occurs or continues.
