A building permit shall be obtained from the building inspector for the construction of swimming pools and spas within the city limits before starting construction of such swimming pools and spas. Plans and specifications of the swimming pools and/or spas to be constructed shall be submitted to the building inspector for review and approval. Final approval of the swimming pool and/or spa shall be withheld until compliance with the requirements of this article.

No building permit for a swimming pool and/or spa shall be issued until the applicable fee has been paid to the city, according to the building permit fee schedule referred to in section 23.01.001(a)(1). The permit fees required by this section shall be paid prior to any work being commenced on the swimming pool or spa.

(a) 
No private or residential swimming pool shall be connected to the city's sanitary sewage system, and connection is hereby specifically prohibited.
(b) 
Drainage of pools and spas shall be confined to the property upon which the pool or spa is located, and it shall be unlawful for water from any residential pool or spa to drain across the property line of an adjacent lot. Such drainage shall be channeled to the storm drainage system by an appropriate method so that the water does not stand and create an offensive or unsanitary condition.

Every swimming pool within the city shall be completely surrounded by a fence, wall or building not less than six feet in height. The provisions of this section shall not apply to a swimming pool completely enclosed within a building.

Each fence or wall constructed around a swimming pool shall meet the following specifications:
(1) 
Construction requirements.
Each fence or wall shall be so constructed as not to have openings, holes or gaps larger than four inches in any dimension. Such fence shall be permanent, shall be set and anchored firmly in the earth and may be constructed of any suitable material, including wood, metal, concrete, brick or masonry, but excluding barbed wire and chain link.
(2) 
Entrances.
All entrances through the fence shall be protected by a substantial gate or door, which shall be equipped with self-closing and self-latching devices capable of keeping such gate securely closed when not in use. Such latching device shall be attached to the upper quarter of the gate or fence on the inside thereof, except that the door of any dwelling which forms a part of the enclosure of a swimming pool need not be so equipped.

(a) 
Filling pool with water
. No water shall be placed in any swimming pool within the city by any person unless and until there shall be erected and in place a fence, wall or building of not less than six feet in height, which fence, wall or building must surround the swimming pool and meet the construction specifications set forth in section 24.03.032.
(b) 
Use of pool
. No swimming pool shall be used for swimming or any other activity normally associated with a swimming pool unless and until there shall be created and in place surrounding the swimming pool a fence, wall or building of not less than six feet in height, which fence, wall or building must be in compliance with the construction specifications set forth in section 24.03.032.
