[HISTORY: Adopted by the Town Board of the Town of Bethlehem 3-23-2022 by L.L. No. 1-2022. Amendments noted where applicable.]
There is hereby created the Department of Recycling and Composting for the Town of Bethlehem. This Department shall consist of the Head of Recycling and Composting and such other employees as may be needed.
There is hereby created the position of Head of Recycling and Composting, who shall be appointed by the Town Board as provided by law. The Head shall have control and supervision over all employees assigned to the Department. The Head shall report directly to the Town Supervisor.
The Department of Recycling and Composting shall be responsible for:
A. 
The supervision of all solid waste, transfer station, recycling and compost facilities.
B. 
Administration and management of Town solid waste and recycling programs in accordance with the requirements of the Town Code.
C. 
Overseeing the operations of the transfer station and compost facility, and any other solid waste, recycling and/or composting facilities that may be added in the future.
D. 
Maintaining data necessary for the Comptroller's office and NYSDEC and submitting necessary reports as required.
E. 
Filing and maintaining state permits for solid waste, compost and transfer station facilities.
F. 
Overseeing the fiscal management of the solid waste facilities.
The employees of the Sanitation Division of the Highway Department, performing functions which are hereby transferred to the Department of Recycling and Composting, shall be continued as employees of the Department of Recycling and Composting with the same classification, salary, benefits, pensions and retirement rights and privileges as they had immediately prior to such transfer.
A. 
Nothing herein contained shall be construed to delegate or transfer any power of the Town Board contained in §§ 12, 51, and 64 of the New York State Town Law or provided for by the New York State Municipal Home Rule Law or other powers which may be lawfully exercised by said Board.
B. 
The Town Board shall establish or set the rates for fees for the facilities overseen by and the services provided by the Department of Recycling and Composting.
Nothing herein contained shall be construed to delegate or transfer any power of the Town Supervisor contained in § 29, § 52 or § 119 of the New York State Town Law or any other powers which may be lawfully exercised by said Supervisor.
Before entering upon the duties of his office, the Head of Recycling and Composting shall take and file with the Town Clerk an oath of office. They shall possess, at minimum, the qualifications required by the Town's Waste Recycling Coordinator civil service position title.
