Any livestock or fowl found within this city in violation of the provisions of this chapter may be taken up and impounded by the city.

The owner of any livestock or fowl which has been impounded under the provisions of this article shall have the right to redeem the same upon the payment of any and all fees which may be due and payable for such impoundment; provided, however, that the payment of such impoundment fees shall not bar the imposition of any fine which may be imposed for the violation of this chapter.

Any impounded livestock or fowl shall be redeemed by its owner within 48 hours after personal notice that the same was impounded, or if the owner is unknown, within 72 hours after public notice. Any such livestock or fowl not redeemed within such time may be sold or otherwise disposed of as provided in this article.

The fees to be charged for the impoundment of livestock or fowl under the provisions of this article shall be as determined by the city council from time to time.

Should the owner of any livestock impounded under the provisions of this article fail, refuse or neglect to redeem the same, the animal control officer may sell the same to the highest bidder at an auction to be held after three days’ notice is given of such sale. After such sale, the animal control officer shall turn over the proceeds thereof to the city manager or designee, who shall credit the amount against any and all costs incurred by the city arising from such impoundment, and pay the excess, if any, to the owner of such livestock.
