Parking.
Parking, sitting or standing unattended, except the parking or standing of the vehicles described in this article, for the purpose of expeditious loading and unloading of passengers, freight or merchandise on the right-of-way of any street, alley, parkway, highway or boulevard. “Parking” does not include vehicles or equipment required for the construction of public projects or for any work done pursuant to a permit issued by the city.

Persons who own vehicles found to have been parked in violation of this article shall, upon conviction, be punished by a fine in accordance with the general penalty provision found in section 1.01.009 of this code.

Whenever a peace officer shall find a vehicle standing upon any one of the streets in the listing described in section 12.05.003 hereof, in violation of the provisions of this article, he is authorized to cause the removal of such vehicle at the owner’s expense, or require the driver or person in charge of such vehicle to move such vehicle to a place where parking is not prohibited by ordinance.

The city manager shall cause to be placed at various locations along the streets in the listing described in section 12.05.003 hereof, signs calling to the public’s attention that there shall be no parking along such street or streets.

(a) 
It shall be unlawful for any person to park or allow to be parked any oversized commercial vehicles on any property under their control, on any portion of a front yard, side yard or rear yard of any area or district which is residentially zoned under the comprehensive zoning ordinance or used for residential purposes.
(b) 
For purposes of this section, oversized commercial vehicles shall mean any vehicle designated below, or any vehicle designed for the transport of property or cargo with a gross weight, registered weight or gross weight rating, as those terms are defined in state law, of more than fifteen thousand (15,000) pounds, or any vehicle designed for the transport of more than fifteen (15) passengers, inclusive of the driver. Designated vehicles, for purposes of this section, are dump trucks, truck-tractors, concrete mixing trucks, stake-bed trucks, buses, trailers which are more than twenty (20) feet in length from end to end, more than seven (7) feet in width at their widest point, or more than seven (7) feet in height at their highest point, or vehicles similar to any of the listed vehicles. The term “oversized vehicle” shall exclude any self-contained recreational vehicle which has a kitchen, bath, or sleeping quarters and is designed for recreational purposes.

(a) 
For purposes of this section, driveway shall mean the area between the curb cut or drive approach from a public street or alley, to a garage, carport or rear yard vehicle storage area as shown in diagram #1A and #1B.
(b) 
Except as provided in subsection (d) below, parking spaces and any adjoining private driveways shall be constructed of an improved monolithic surface of concrete or asphalt or other paved surface approved by the building official. The paved surface shall be two inches (2") or more in thickness and shall not exceed one-half inch (1/2") in height above the adjacent unpaved surface and shall be located perpendicular to the curb cut or drive approach as shown in diagram #1A. On nonconforming lots without paved parking spaces and driveways existing as of the effective date of this article, the parking spaces and driveways shall only be located perpendicular to the curb cut or drive approach as shown in diagram #1B.
(c) 
Except as provided in subsection (d) below, all vehicles shall be driven and parked so as to completely rest upon a paved surface or driveway. On nonconforming lots without paved parking spaces and driveways existing as of May 18, 2010, all vehicles shall be driven and parked so as to completely rest upon the unpaved parking spaces or driveways as provided in this section, or in the side yard adjacent thereto. No parking spaces shall be permitted in the remaining front yard portion as shown in diagrams #1A or #1B, unless it is paved in accordance with subsection (b) above.
(d) 
The requirement for paving provided in subsections (b) and (c) above shall not apply to residential properties meeting all of the following:
(1) 
Property shall exceed one and one-half (1-1/2) acres;
(2) 
The garage, carport or vehicle storage area is located more than one hundred fifty (150) feet from the front property line; and
(3) 
The garage, carport or vehicle storage area is located behind the dwelling and is screened from public view.
