(a) 
No person shall move any building along, across, or upon a public highway or across the land of the building's owner without first obtaining a moving permit approved by the Building Inspector or designee. The applicant shall provide documentation as to whether the building is sufficiently sound for the applicant to move. The documentation shall comply with applicable requirements of this Code. The permit application shall comply with this chapter.
Exception: The Village shall not require a moving permit for mobile homes, modular homes, modular buildings, sheds, and other accessory buildings that a person may transport within the guidelines for standard or oversize loads set forth by WisDOT.
(b) 
The application for a permit to move a building shall designate the route taken and the time limit for moving the said building. When applicable, applicants shall first obtain approval from WisDOT, Racine County, and utility companies. The Village staff may institute appropriate conditions for the movement of buildings to protect persons and property.
(c) 
The application shall include a plat of survey of the property on which the applicant plans to locate the building if within the Village. In addition, the applicant shall provide a site plan, landscape plan, and grading plan for review and approval if applicable. Applicants shall also apply for a building permit for moved buildings located within the Village.
(d) 
The Inspector shall refer the application and all documents to applicable Village departments for review and approval. The Village staff retain the right to forward any applications to the plan Commission for review and approval.
(e) 
The permit applicant shall post a bond with the Village in the sum determined by Village staff after considering the hazards present in moving such building, such as damage to roads, fences, trees, shrubbery, utility wires, signs, and other obstructions. The Village shall not require a bond for moving a building from one location to another on the same premises.
(f) 
The permit applicant shall file with the Village an insurance certificate covering liability for death, personal injury, or property damage in the amount as determined by the Village. The applicant's insurance certificate shall name the Village as an additional insured. Neither the Village nor any of its officials shall hold liability for any injury to persons or property resulting from the movement of the building.
(g) 
The Village shall not allow any building to move on any public street, to remain overnight on any street crossing, intersection, pedestrian crossing, or to block access to any fire hydrant or public building. In addition, the Village shall require barricades, warning lights, and other devices to protect persons using the public highways.
(h) 
The Public Works Department shall inspect utilized streets and ways upon completion of the moving. Any damages caused by said movement shall be the responsibility of the permit holder. The applicant shall pay for any damages before the Village releases the applicant's bond. If the applicant does not pay said damages within 30 days from the invoice date, the Village shall draw on the bond the corresponding amount.
