There is hereby created an Emergency Medical Services Advisory Board.

The Emergency Medical Services Advisory Board shall be composed of nine members, more particularly identified as follows:
(1) 
City manager, or his designee.
(2) 
Fire chief, or his designee.
(3) 
City manager of the City of Burkburnett, or his designee.
(4) 
City administrator of the City of Iowa Park, or his designee.
(5) 
Wichita County Judge, or his designee.
(6) 
One appointment by the mayor and city council who is licensed to practice medicine in the state.
(7) 
One appointment by the mayor and city council with no specific qualifications.
(8) 
One appointment by the county commissioners with no specific qualifications.
(9) 
One appointment to be shared by the governing bodies of the cities of Burkburnett and Iowa Park with no specific qualifications.

(a) 
A chairperson for the Emergency Medical Services Advisory Board shall be selected by the appointed members from among the group. The term of office as chairperson will expire at the end of the calendar year annually, and the chairperson shall be eligible for reelection.
(b) 
The board shall meet not less than annually, and minutes from each meeting with observations and recommendations shall be submitted to the city council at a regularly scheduled council meeting.
(c) 
The members of the board shall be residents of the entities by whom they were appointed. The appointed members shall serve for terms of two years; however, the initial terms shall be staggered so that the appointment made by the county commissioners and the appointment shared by Burkburnett and Iowa Park (section 2-391(8) and (9)) shall be initially appointed for a term ending December 31, 2008, and the appointments by the city (section 2-391(6) and (7)) shall initially be made for terms ending December 31, 2009. Thereafter, all members’ terms shall end on December 31. Each member shall continue to serve until his successor is appointed. A member may be removed for any reason by the entity that made the appointment.

(a) 
All members of the Emergency Medical Services Advisory Board shall have the same powers as any other member, including the right to vote, on all matters before the board.
(b) 
No person shall serve on the board if such person is an officer, director, employee, or is otherwise affiliated with, directly or indirectly, any ambulance operator whose activities are regulated by chapter 42.
(c) 
The Emergency Medical Services Advisory Board shall meet at least once annually to monitor the following sections of the joint ambulance services contract between Wichita County and the cities of Wichita Falls, Burkburnett and Iowa Park:
(1) 
Personnel.
(2) 
Vehicles.
(3) 
Financial information.
(4) 
Service level.
(d) 
In addition to the minimum annual meeting, the board shall meet on an as-needed basis to review any citizen complaint received by any of the entities related to the provision of emergency medical services under the ambulance services contract. Any complaint must be written, signed and sent to the attention of any of the governing bodies of the entities to convene a meeting of the board. It shall be the responsibility of the recipient to direct the complaint to the Emergency Medical Services Advisory Board.
(e) 
The Emergency Medical Services Advisory Board’s authority to review the service under this division shall in no way affect the independent contractor relationship between the entities and any contractor under this division, and the review thereof is to make inquiry as to whether or not adequate emergency medical services are being provided to the citizens of the city, but not for the purposes of controlling the duties or functions of the operation or specific means or manner of supplying such service by the contractor.
