(a) 
There shall be created an advisory Public Board of Health which shall advise the members of the local public health district on matters of public health.
(b) 
The board shall have the advice and cooperation of the director/health authority and the city manager in the performance of its duties.

(a) 
The Public Board of Health shall consist of 11 representatives. Seven of the representatives shall be voting representatives and four shall be nonvoting representatives.
(b) 
Two of the voting representatives shall be citizens of the county who reside outside the city and shall be appointed by the county commissioners. However, if the Commissioners’ Court makes no appointments within 30 days of a request for appointment by the city, the city council may proceed to fill the positions.
(c) 
Five of the voting representatives shall be appointed by the city council.
(d) 
Insofar as is possible, voting representatives shall be selected from the following classes:
(1) 
Voting representatives.
a. 
One legally qualified, licensed and practicing physician approved by the medical society of the county.
b. 
One legally qualified, licensed and practicing veterinarian.
c. 
One legally qualified, licensed, and practicing dentist.
d. 
One registered nurse.
e. 
Two interested citizens at large.
f. 
One member of either the Texas Restaurant Association or the Texas Grocer’s Association.
(2) 
Nonvoting representatives.
The nonvoting representatives are designated as follows:
a. 
The county judge or his representative.
b. 
The city manager or his representative.
c. 
The director/health authority.
d. 
The manager.

(a) 
Voting representatives of the Public Board of Health shall be appointed for two-year terms and may be reappointed for two additional two-year terms. The voting representatives may not serve concurrent terms that exceed six years.
(b) 
Public Board of Health voting representatives will serve two-year terms, except that three of the voting representatives will be appointed for one year to ensure staggered terms. Each representative may be reappointed for two additional two-year terms.
(c) 
An unexpired term will be filled from the representative class in which the vacancy occurs.
(d) 
Representatives’ terms of office shall expire December 31.

Each representative of the Public Board of Health must have resided in the public health district for a period of three years prior to appointment.

Representatives of the Public Board of Health shall serve without compensation.

(a) 
A representative of the Public Board of Health may be removed by the appointing body or by a majority vote of the remaining representatives present, provided that there is a quorum of five voting representatives and providing that the county Commissioners’ Court approves the removal of any representative who resides outside the city limits. Action may be initiated by the appointing body or by any representative of the board. The representative being considered for removal shall be provided an opportunity to be heard by the board before the vote is called.
(b) 
A representative may be removed by the voting representative as provided in subsection (a) of this section or by the appointing body for neglect of duty, incompetence, malfeasance, or conviction of a felony or misdemeanor involving moral turpitude. However, if any representative misses three consecutive regular meetings without being excused by the board as a whole, the board shall declare a vacancy and notify the appointing authority of such fact so that vacancy may be filled.

(a) 
The nonvoting representatives of the Public Board of Health shall receive the advice of the board on matters of public health, including the budget.
(b) 
The director/health authority and the manager shall administer programs, and shall report to the state Board of Health and the Public Board of Health as the situation warrants.

(a) 
The Public Board of Health shall elect a chair, a vice-chair and a secretary and shall adopt rules for the conduct of its meetings.
(b) 
Four voting representatives shall constitute a quorum for the transaction of business.
(c) 
The board shall meet bimonthly on the second Friday of the first month, or at such special meeting as may be called by the chair, the director/health authority, or the city manager.
