It shall be unlawful for any person to direct the placement or display of any goods, wares, merchandise or other commodity for sale upon any sidewalk, sidewalk area or parkway within the city without a street use permit.

No street use permit shall be necessary for sidewalk sales that are of no more than one day’s duration up to a maximum of three nonconsecutive days per calendar month.

(a) 
An applicant for a permit hereunder shall file with the city an application showing:
(1) 
Name and address of the owner or agent in charge of the property abutting the proposed area of display;
(2) 
Proposed length of time the display is to remain;
(3) 
Location of the display area (which shall be not less than four feet from the curb or curbline); and
(4) 
A short statement of precautions to be taken to assure pedestrian safety.
(b) 
The city shall issue a permit under this section when it is found:
(1) 
The plans for the proposed operation are in conformity with pedestrian safety;
(2) 
The applicant has submitted a duly executed application, containing all of the information and data required, including evidence of liability insurance coverage;
(3) 
The proposal is part of a recognized holiday celebration or part of a multi-merchant sidewalk sale special activity in addition to an individual marketing activity of the applicant;
(4) 
The operation will not unreasonably interfere with vehicular and pedestrian traffic, the demand and necessity for parking spaces and the means of access to and from the property affected and adjacent properties; and/or
(5) 
The health, welfare and safety of the public will not be unreasonably impaired.
