For the purpose of this division, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
The city’s cemetery and its lots, streets and walkways.

Any person, firm, or corporation violating any provision of this division shall, upon conviction, be fined as provided in section 1.01.009 of this chapter.

The cemetery shall be used exclusively for the burial of the human dead. Lots may be sold only for that purpose. Should any lot sold be utilized for another purpose, the city reserves the right to reclaim ownership of the lot and tender refund of the purchase price, less costs of restoration.

(a)
The city reserves the right to level gravesites, to plant grass (and mow it), to lay out avenues and walkways, to establish boundary lines and to establish supplemental rules and regulations for the care and control of grounds.
(b)
The city reserves the right to utilize adjacent lots for opening, closing and maintenance of gravesites.

The price of lots shall be as determined from time to time by the city council. No burial will be permitted in any lot, nor a deed tendered therefor, until the purchase price shall have been paid in full to the city secretary. Should any burial in violation of this section occur, the city secretary shall direct the removal of the body from the lot and shall direct that the body be re-buried as a deceased indigent.

(a)
It shall be unlawful to operate any vehicle within the cemetery at a speed in excess of five miles per hour.
(b)
It shall be unlawful to operate a vehicle within the cemetery so as to execute a 180-degree turn within the bounds of a single roadway or otherwise execute a U-turn.
(c)
It shall be unlawful to operate a vehicle within the cemetery at any point outside designated streets and roadways, except for maintenance and burial purposes.
(d)
It shall be unlawful to place within the cemetery any sign indicating that a lot or lots are for sale.
(e)
It shall be unlawful to place within the cemetery any business advertisement.

It shall be unlawful to erect within the cemetery any marker at the foot of the grave which extends more than seven inches above grade level.

The city shall not be responsible for the safekeeping of any thing or article erected or placed at any gravesite. Funeral designs and floral pieces will be removed from graves when they become unsightly, as by wilting. Any that are to be retained by the family of the deceased must be removed within 48 hours after interment.
