Ordinance No. 2-82 of the Town of Brooklyn heretofore in effect since July 13, 1982, be and it is hereby repealed and recreated as set forth herein.
No dog shall run at large in the Town. A dog shall be deemed at large unless under the control of a person by means of a chain, rope or leash of sufficient strength to control the dog or unless the dog is kept in a substantial enclosure.
A person designated by the Town Board by resolution as dog catcher shall be responsible to apprehend any dog running at large contrary to this article and confine for three days, during which time its owner or representative may reclaim the animal upon the following conditions:
A. 
Presentation of evidence that the dog is licensed and has a suitable collar;
B. 
Presentation of evidence that the dog is vaccinated against rabies or a receipt from a licensed veterinarian for prepayment of a rabies inoculation;
C. 
Payment of an impoundment fee of $150 to the dog catcher. Payment of said fee will be in lieu of any charge by the dog catcher to the Town for picking up and boarding of said animal.
In the event the owner is unknown or does not claim the dog within three days, the dog may be released to a person other than the dog's original owner upon the following conditions:
A. 
The person to whom the dog is released signs a statement agreeing to license the dog and have the dog vaccinated against rabies, unless evidence is presented that the dog is licensed and vaccinated.
B. 
The new owner further agrees to hold the Town and the dog catcher harmless as to any claim made by any former owner.
A dog not released to its owner or another within the impoundment period, a minimum of three days, may be disposed of by releasing it for humane purposes, as provided in § 174.13, Wis. Stats., or by disposing of the dog in a proper and humane manner.
