It shall hereafter be unlawful for any person, firm, corporation or co-partnership, to sell, offer for sale, expose for sale, use, discharge or explode fire crackers, torpedoes, sky rockets, Roman candles, aerial salutes, American or Chinese bombs or other fireworks of like construction, or any fireworks containing any explosives or inflammable compounds or any tablets or other device commonly sold and used as fireworks containing nitrates, chlorates, oxalates, sulphides or lade, barium, antimony, arsenic, mercury, nitroglycerine, phosphorus or any compound containing any of the same or other modern explosives within the limits of the City of Sundown, Texas.

It shall be unlawful for any person, firm or corporation to sell within 50 feet of the city limits of the City of Sundown, Texas, offer for sale, expose for sale any of the fireworks mentioned and set out in Section 5.401 of this article.

It shall be unlawful for any person, firm or corporation while in the corporate city limits of the City of Sundown, Texas, to use, ignite by fire, combustion or friction, any of the fireworks mentioned and set out in Section 5.401 of this article.

(a) 
Nothing herein contained shall prohibit the use of fireworks for pyrotechnic displays given by fair associations, amusement parks, civic organizations or groups of individuals under permit granted therefore by the city secretary of the City of Sundown, Texas. Nor shall the provisions of this article prohibit the use or sale of blank cartridges for theatrical purposes or for signal purposes in athletic contests or sports events, or for use by the police or military organizations, and nothing herein contained shall be construed to prohibit the use or sale of colored flares.
(b) 
There are hereby excepted from this article and are not to be considered as fireworks, and shall be allowed to be used and sold at all times, the following:
(1) 
Toy pistols, toy canes, toy guns, or other devices in which paper and/or plastic caps are used and paper and/or plastic caps used in such pistol, cane gun, or other devices.
(2) 
Model rockets and model-rocket motor designates, sold and used for the purpose of propelling recoverable aero models.
(3) 
Propelling or expelling charges consisting of a mixture of sulfur, charcoal, and saltpeter.
(4) 
Snake, Glow Worm.
Pressed pellet of pyrotechnic composition that produces a large, snake-like ash upon burning. The ash expands in length as the pellet burns. Such devices may not contain mercuric thiocyanate.
(5) 
Smoke Device.
Tube or sphere containing pyrotechnic composition that, upon ignition, produces white or colored smoke as the primary effect.
(6) 
Wire Sparkler.
Wire coated with pyrotechnic composition that produces a shower of sparks upon ignition. These items may not contain magnesium and must not exceed 100 g (must be labeled as to amount) of composition per item. Devices containing any chlorate or perchlorate saltes may not exceed 5 g (must be labeled as to amount) of composition per item.
(7) 
Trick Noisemaker.
Item that produces a small report intended to surprise the user. These devices include:
(A) 
Party Popper.
Small plastic or paper item containing not more than 16mg (must be labeled as to amount) of explosive composition that is friction sensitive. A string protruding from the device is pulled to ignite it, expelling paper streamers and producing a small report.
(B) 
Booby Trap.
Small tube with string protruding from both ends, similar to a popper in design. The ends of the string are pulled to ignite the friction-sensitive composition, producing a small report.
(C) 
Snapper.
Small, paper-wrapped item containing a minute quantity of explosive composition coated on small bits of sand. When dropped, the device explodes, producing a small report.
(D) 
Trick Latch.
Kitchen or book match that has been covered with a small quantity of explosive or pyrotechnic composition. Upon ignition of the match, a small report or a shower of sparks is produced.
(E) 
Cigarette Load.
Small wooden peg that has been covered with a small quantity of explosive composition. Upon ignition of a cigarette containing one of the pegs, a small report is produced.
(F) 
Auto Burglar Alarm.
Tube which contains pyrotechnic composition that produces a loud whistle and/or smoke when ignited. A small quantity of explosive, not exceeding 50 mg (must be labeled as to amount), may also be used to produce a small report. A squib is used to ignite the device.
