Any person who violates any condition of this article shall, upon conviction, be fined an amount not less than fifty dollars ($50.00) nor more than two hundred dollars ($200.00).

No person shall have a garage or yard sale within the city limits without first obtaining a permit therefor.

Any person desiring to have a garage or yard sale shall make application in the city hall office. Such application shall state the name of the person who is having the sale, the address of such person, the location of the sale, and the dates of the sale. A copy of the permit shall be posted in a conspicuous place during the time and at the place where the sale is being held. The city office shall collect a permit fee in the amount adopted by the city council.

(a) 
The sale of tangible personal property at retail must be conducted by the property owner who does not hold himself out as engaging, nor does habitually engage, in the business of selling such tangible personal property at retail.
(b) 
The owner or occupant of such residential property wishing to conduct thereon a garage or yard sale shall be limited to two (2) permits per calendar year, each of said permits to cover a period of time not to exceed three (3) days.
(c) 
The tangible personal property shall be sold only on the premises of the owner or lessee of the property where the sale is conducted and such owner or lessee must be the legal owner of the tangible personal property at the time of the sale.
(d) 
All sales shall be confined to the porch, garage, patio, interior room of dwelling, and yard of the premises.
(e) 
No merchandise acquired solely for the purpose of resale shall be sold.

(a) 
Sales by churches, schools, charities, and fraternal organizations for the purposes of raising funds may be held on property other than that owned by the organization, and tangible personal property donated by members or others may be sold.
(b) 
The Chamber of Commerce (CoC) sponsored city-wide garage sale is exempt from all conditions of this article; however, participants in this garage sale must comply with all requirements of the Chamber of Commerce, to include the purchase of garage sale permits from the CoC.
