It shall be unlawful to abandon a refrigerator or freezer within the city without removal of the door or doors, or using the option of placing a lock or locks on said doors. To abandon means to leave outdoors and unattended.

(a) 
It shall be unlawful to place or cause to be placed any items or materials into the main drainage ditches of the city, or to allow any items or materials from adjoining drainage ditches to be carried into the main drainage ditches by rainwater runoff.
(b) 
Any person, business or corporation found to be guilty of the provisions of this section as specified in subsection (a) by a court of competent jurisdiction may be fined in accordance with the general penalty provided in section 1.01.009 of this code plus all associated court costs.

(a) 
Prohibition.
It shall be unlawful for a person to possess an open container which contains any amount of alcoholic beverage within public view in the city and the extraterritorial jurisdiction of the city.
(b) 
Applicability.
(1) 
This section does not apply to persons that are on private property with the owner’s consent.
(2) 
This section will not replace or supersede any of the state Alcoholic Beverage Code.
(3) 
Alcohol possession and consumption is prohibited in all city-owned areas and structures except the city-owned Caywood Center (“Center”). The city may permit alcohol possession and consumption at the Center. Alcohol will not be permitted at a city-approved Center event unless the event holder signs and returns to the city all required city documentation and forms. Abuse of alcohol will be cause for removal of the event holder and all related personnel at the Center.
(c) 
Reasonable suspicion.
If an officer has reasonable suspicion that a person may be in violation of this section, the officer may approach the subject to determine if the subject is in violation.
(d) 
Definitions.
As used herein:
Extraterritorial jurisdiction
means any property outside the city limits that is owned or operated by the city. Also property owned by the city and operated by a private entity with permission of the city.
Open container
means a bottle, can or other receptacle that contains any amount of alcoholic beverage and that is open, that has been opened, that has a broken seal, or the contents of which are partially removed.
Owner consent
means consent by the city, or a representative for the city, for public property, and consent by the owner/operator, or representative for the owner/operator, of private property.
Possession
means in the possession of a person or within reasonable proximity of a person which would constitute reasonable belief that it was the person’s.
Private property
means any property in the city and the extraterritorial jurisdiction of the city (GC 29.003) owned or operated by a business, private entity, or person.
Public property
means any property of the city and the extraterritorial jurisdiction of the city (GC 29.003) held for public use by the city, which will also includes sidewalks and any thoroughfare.
Public view
means can be observed by the public.
(e) 
Penalty.
Any person in violation of this section shall be deemed guilty of a misdemeanor and can be fined in any sum in accordance with the general penalty provided in section 1.01.009 of this code plus court costs.
