(a) 
Adoption.
(1) 
The latest edition of the manual entitled “Standard Specifications for Public Works Construction,” prepared by North Central Texas Council of Governments, shall govern the construction of all public works and utility construction. Any ordinance passed which is in conflict with these standards is hereby deemed to be controlling.
(2) 
The town adopts the addendum to the North Central Texas Council of Governments Standard Specifications for Public Works Construction, 4th edition, dated July 25, 2008 (“the addendum”) to read as shown on exhibit 1 on file in the office of the town secretary, which is incorporated by reference herein as if fully set forth, and in the event of a conflict between the addendum and any provision of chapter 4 of the Code of Ordinances or the subdivision ordinance, including, without limitation, this section and/or article 4.02 (construction codes and standards), then the addendum shall govern.
(3) 
The minimum pavement thickness shall be six inches for any public street constructed after the date of this subsection.
(b) 
Payment of testing and inspection fees.
All fees and charges incurred for testing and/or inspection of public works projects in the town shall be contracted for and paid directly by the contractor doing the work.
(c) 
Submission of reports of tests and inspections.
Those firms undertaking such tests and inspections shall submit reports directly to the town manager as well as the contractor.

(a) 
Generally.
It shall be unlawful to conduct business concerning or commence construction of any building or structure without first obtaining a permit and paying any necessary permit fees. Permit fees required are as set forth in the fee schedule in appendix A of this code.
(b) 
Tennis courts.
It shall be unlawful to commence installation of a tennis center, tennis court or any other outdoor paved game surface without first obtaining a permit and paying necessary permit fees as provided for in the fee schedule found in appendix A of this code.

(a) 
Construction hours.
Construction and construction related activities within the town shall not begin earlier than 7:00 a.m. on weekdays nor continue after 7:00 p.m. when work is on or adjacent to a residential use. Construction on Saturday shall not begin before 8:00 a.m. nor continue after 7:00 p.m. when work is on or adjacent to a residential use, and work on Sunday or a federal holiday is prohibited without special permission from the town manager or designee. The construction related activity includes but is not limited to the maintenance, servicing and fueling of construction equipment.
(b) 
Construction traffic; street or lane closures; barricades and warning devices.
(1) 
Construction traffic.
The delivery of construction related materials and/or equipment shall not begin earlier than 7:00 a.m. on weekdays nor continue after 7:00 p.m. It is the responsibility of the developer/contractor to use good judgment when scheduling work in construction zones located in close proximity to residences, schools, churches, businesses, etc. This is to ensure that citizens are not subjected to undesirable or excessive construction noise. At locations where voluntary compliance is not being observed the town may issue written stop-work orders or may also issue citations if it is determined that a violation of this section or article 8.06 (Noise) exists.
(2) 
Street closures or detours.
Except in an emergency, all street closures or detours that will exceed 24 hours in duration shall require an approved traffic-control plan and shall be posted by a sign or traffic-control device at least two days prior to the closure or detour. All traffic-control devices shall be in place prior to the start of construction. All lane closures shall comply with the Texas Manual on Uniform Traffic Control Devices. Traffic-control plans shall be submitted and approved by the town engineer. Alterations to these lane closure times shall be approved by the traffic engineer or designee.
(3) 
Barricades and warning devices.
In performing the work, a permittee shall furnish and install the barricades, flares, and lights as necessary, and in compliance with the Texas Manual on Uniform Traffic Control Devices and an approved traffic-control plan. In the event there is a conflict between the provisions of this article and the provisions of the Texas Manual on Uniform Traffic Control Devices, the latter shall be controlling.
(4) 
Flaggers.
During the time the work is actually being conducted, the permittee shall provide flaggers to alert the public to the work, when required by the Texas Manual on Uniform Traffic Control Devices or when required by the town.
(5) 
Construction near school.
Any work that may involve construction within the public rights-of-way adjoining a school within the town must be coordinated with the town so as to minimize traffic conflicts and street closures during school days. Lane closures near schools shall be limited to 9:00 a.m. to 2:00 p.m. while school is in session. Alterations to these lane closure times shall be approved by the town manager or designee.
(6) 
Informational sign for large developments.
For large developments with continued construction longer than seven (7) days, a minimum three feet by three feet informational sign with four-inch letters stating the identity and the telephone number of the permittee shall be placed at the location where construction is to occur prior to the beginning of the work. The sign shall be placed within 5 feet of the stormwater prevention plan permit for the project. The sign shall continue to be posted at the location during the entire time of construction.
(c) 
Related provisions.
The definitions, exemptions and other relevant provisions of article 8.06 (Noise) shall apply for purposes of this section.
