The moving of houses, barns, sheds, or other structures on and over the streets of the town is prohibited, unless the person, firm or corporation desiring to make such a move makes written application in duplicate, not more than seventy-two (72) hours before the time of such move, to the town secretary. Such application shall show the approximate size of the structure to be moved, its origin and destination, the route to be followed, and the date and approximate hour of the move.
(1992 Code, sec. 3.401; 2006 Code, sec. 3.401)
Such application shall be accompanied by a fee as provided for in the fee schedule in appendix A of this code, and a permit shall then be issued by approving the duplicate copy of the application.
(1992 Code, sec. 3.402; 2006 Code, sec. 3.402)
No such permit shall issue unless the applicant has filed or shall then file with the town secretary a bond executed by a surety company in the amount of one thousand dollars ($1,000.00), payable to the town. Such bond shall be conditioned that the applicant will pay for any damage caused to public or private property resulting from any such moves made by the applicant during that calendar year, and that the town or any owner of an interest in property therein damaged by such move may recover thereon, and that the liability on the bond shall not be diminished by any recovery. No permit shall be issued to any applicant who has not paid off for damages resulting from a prior move, whether or not in dispute.
